Mr. Mark Lawrence, applicant, stated he was in the process of purchasing <br />insurance with a $1,000,000 limit in accordance with the modified condition <br />of the Conditional Use Permit. He explained the safety precautions taken in <br />the operation of Skateworld. He stated he felt he should not be held respon- <br />sible for accidents off his property and that there was no insurance available <br />for such coverage. He urged favorable consideration of L~his application. <br /> <br /> Mr. Ben Fernandez, Insurance Broker for the City, expressed concern for <br />the safety of children traveling on Hopyard Road to Skateworld, and stated he <br />felt that Skateworld was not in a proper location. He urged the facility not <br />be allowed in its present proposed location because it was not in the best <br />interests of the City. <br /> <br /> Mr. Roger ~Iillinouslsupported denial of the facility because of safety <br />reasons. <br /> <br /> Mr. Lax~rence stated he felt he should not be denied approval of his <br />facility because of insurance he could not obtain. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed. <br /> <br /> Councilmember Brandes presented background information on his appeal. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by <br />Councilmember Kephart, that Resolution No. 78-133, granting approval of the <br />appeal by Frank C. Brandes, Jr., of the Planning Commission decision of April <br />19, 1978, modifying Condition 11 of Resolution No. 1527, granting a Conditional <br />Use Permit to Mark Lawrence for Skateworld, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Review of a negative declaratio~ .~.or. a S~fet~ Element of the Pleasanton General <br />Plan (Continued Open from 4-25-78) <br /> <br />~pplicat!on pf. the Cit~ of Pleasanton for the adoption .qf a Safety Element to <br />the Pleasanton General Plan which would contain ~oals~ policies and implemen- <br />tation programs with respec.t to protection from fire~..flood~' ~.eologi~ and ~ <br />nuclear hazards (Continued Open from 4-25-78) <br /> Mr. Harris presented his report dated April 17, 1978, regarding these two <br />items. He also presented a letter from the League of Women Voters dated May <br />23, 1978, regarding their specific areas of concern and comment. <br /> <br /> Mayor Mercer declared the public hearing open on the negative declaration <br />and the application. <br /> <br /> Mrs. Joy Robinson, representing the League of Women Voters, read their <br />letter to the City Council, and recommended that the Safety Element not be <br />adopted until their concerns had been resolved.
