It was moved by Councilmember Mercer, and seconded by Councilmember Kephart, <br />that Ordinance No. 891, to be read by title only and waiving further reading <br />thereof, amending Title V (Vehicles and Traffic), Chapter 5 (Commercial Vehicle <br />Regulation) by adding Article 2 to prohibit overweight vehicles from certain <br />roads and granting a temporary permit for certain quarry trucks, be introduced. <br />The roll call votewas as fellows: <br />AYES: Councilmen Kephart, Mercer, Wood, and Mayor Brandes <br />WOES: None <br />ABSENT: Councilman Butler <br /> <br /> Mayor Brandes stated the resolution directs and authorizes the City Manager <br />to give ninety (90) days notice of termination of the agreement to the gravel <br />producers. <br /> <br />~ppeal of Robert Pearson and John Fra~a of a decision of the Design ~eview Board <br />that a concrete products manufacturing plant proposed to be located on the west <br />side of Valley Avenue between the Western Pacific Railroad ~r~c~s and Utility. <br />Vault property would not have a significant impact on the environment <br /> Mr. Harris presented his report dated June 4, 1979, regarding this matter, <br />which recommends denial of the appeal. <br /> <br /> ~Iayor Brandes declared the public hearing open. <br /> <br /> Mr. Robert Pearson, 3590 Churchill Court, appellant, stated he felt an <br />Environmental Impact Report should be required en the proposed Western Concrete <br />Products Project because of increased truck traffic this business would generate, <br />the impact this would have on residential housing in the area, and the uncer- <br />tainty of the type of additional development on the subject parcel. <br /> <br /> Councilmember Kephart asked if a directed Environmental Impact Report address- <br />ing Transportation/Circulation Impacts and Noise Impacts for this project could be <br />included in the EIR to be prepared for the balance of the 63 acre parcel. Mr. <br />Harris advised it could but it would delay the Western Concrete Products Project <br />two or three months. <br /> <br /> Mr. John Fraga, 1486 Kolln Street, appellant, stated he was concerned over <br />increased truck traffic on Santa Rita Road in the last few months and felt this <br />matter should be given further consideration before allowing more industry which <br />would also increase truck traffic. <br /> <br /> Mr. Bill Morrison, 3575 Chippendale Court, stated he was concerned about in- <br />creased traffic and felt an Environmental Impact Report should be made on the <br />subject project. <br /> <br /> Mr. Richard Rush, Attorney representing Western Concrete Products, stated <br />this particular site had been approved by Council several months ago, that <br />Western Products had created a legal industrial project which was a small <br />research specialty business, that the small number of trucks involved would <br />be considered insignificant under the CEQA guidelines, that he felt this <br />business should have the right to use public streets, and he preferred that <br />no delay be incurred on the proposed development. <br /> <br /> Mr. Robert Pearson rebutted by stating he felt an Environmental Impact Report <br />should be required to show the effects of impact on tranquility of the residential <br />area as well as effect on property values.
