CITY COUNCIL COMMITTEE REPORTS <br /> Councilmembers presented various Committee Reports for the information of the <br />Council. <br /> <br /> Councilmember Wood suggested that the Planning Commission consider meeting <br />bi-monthly instead of monthly due to the number of items on their agenda and the <br />length of meetings. Mayor Brandes supported this suggestion and requested staff <br />to pursue this matter with the Planning Commission. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Ms. Colleen Clancy, Attorney representing Railswap, urged Council to reconsider <br />their earlier decision denying Railswap's referendum petition against the railroad <br />consolidation project. Ms. Clancy noted that she, like the City Attorney, was <br />setting forth an argument and not citing any identical cases. She stated that <br />Railswap would have a very strong case against the City in court and opposed both <br />arguments the Council had used in deciding that its March vote adopting the project <br />could not be put to a referendum. Ms. Clancy told Council its resolution approving <br />that project was patently legislative and definitely subject to a referendum. She <br />challenged the City Attorney's position that consolidation policy was actually set <br /> Cit ' <br />when the y s General Plan map was adopted in 1976. She also challenged the City <br /> Cit ' <br />Attorney's position that consolidation is under the State's authority, not the y s. <br />She stated that Pleasanton is approaching the Public Utilities Commission for project <br />approval, but that the PUC has in no way mandated the plan. Ms. Clancy stated this <br />matter is a land use problem and the decision should lay in the hands of the voters. <br />Mayor Brandes thanked Ms. Clancy for her presentation. <br /> <br />PUBLIC HEARINGS <br />Application of the Planning Commission to prezone a one-acre parcel of land located <br />at 6248 Amber Lane to the R-I-40,000 (Single-Family Residential) District or any <br />other zoning district consistent with the General Plan <br /> <br />On the basis of an Initial..st~.dX of the po.tential environment~.l impacts of the <br />.projet. t, th~ Director of Planning and Community Development has determined that <br />the proposed project would not have any potential significant adverse effects on <br />the environment and that an environmental impact ~eport need not be prepared. <br />This Initia.1..~u~y is available for review at the Planning Div. isiqn~ 200 Bernal <br />Avenue~ Pleasanton. Comments on this decision may be directed to either the <br />planning staff prior to the above meeting date~ or. directly to the City Council <br />at the above noticed meeting <br /> Mr. Harris presented his report dated May 15, 1979, regarding this matter. <br /> <br /> ~4ayor Brandes declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Brandes declared the public hearing closed on the application and the <br />negative declaration. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Wood, <br />that Resolution ~o. 79-90, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br /> Cit ' <br />impact would occur as outlined in the y s guidelines and that a Negative <br />Declaration is appropriate to prezone a one-acre parcel of land located at 6248 <br />Amber Lane to the R-i-40,000 (Single-Family Residential) District, be adopted. <br /> <br /> 3. 5/22/79 <br /> <br /> <br />
