REPORTS OF THE CITY MANAGER <br /> Adoption of Resolution Delegating Certain Authority to City Manager in the Process- <br /> ing of Disabilit~ Retirements r <br /> (Continued from 7-10-79) <br /> Mr. Brown presented his report dated July 3, 1979, regarding this matter. <br /> <br /> Councilmember Kephart stated that various persons had expressed to-him their <br /> concern that delegation of authority in the processing of disability retirements <br /> should not be invested in one person. <br /> <br /> Mr. Brown explained that this is primarily an administrative matter rather than <br /> a policy matter and it is not unfair to the employee to have this done at the <br /> administrative level. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Butler, that Resolution No. 79-122, delegating to the City Manager the re- <br />sponsibility for making all determinations regarding disability as required by PERS <br />and executing all documentation pertaining thereto, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Mercer, and Mayor Brandes <br />NOES: Councilman Kephart <br />ABSENT: Councilman Wood <br /> <br />Further RepoFt~ Re: Litter on Public and Private Property <br /> Mr. Brown presented the report of the Assistant to the City Manager-Miller, <br />dated July 17, 1979, regarding this matter. He advised that the report regarding <br />newspaper litter had not been completed at this time. After discussion, Council <br />determined to continue this item to the meeting of September 11, 1979, in order <br />to discuss all litter concerns at one time. <br /> <br /> Mayor Brandes recessed the meeting at 11:15 P.M. <br /> <br /> Mayor Brandes reconvened the meeting at 11:25 P.M. <br /> <br />Commercial (non-retail) Industrial Sewage Capacity: Proposed Agreement with <br />Willow West Properties <br /> Mr. Brown presented his report dated July 18, 1979, regarding this matter, and <br />reviewed the revised draft agreement. <br /> <br /> Council discussion ensued relative to adding a time element clause to the <br />agreement requiring Willow West to hire a consultant within ninety days and to <br />complete preliminary design plan and environmental studies within one year, with <br />time ~xtension possible under certain conditions. Mr. Brown emphasized that with <br />the many agencies involved, such as the Federal, State, Regional and local govern- <br />ments, a definite timetable would be very difficult to project. <br /> <br /> Mr. John DiManto, representing Willow West Properties, stated he concurred <br />with the staff report with the exception of the manner of repayment to Willow <br />West. He requested the language of this section be clarified to protect Willow <br />West from other land owners delaying development while Willow West pays. He <br />suggested a target date for other landowners to join Willow West. <br /> <br /> Council discussion ensued regarding possible methods of reimbursement to <br />Willow West. <br /> <br /> Mr. Brown reviewed the capacity allocation of 200,000 gallonsreserved for <br />Willow West and the proposed distribution of the remaining 300,000 gallons.
