CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 88-127 RESOLUTION ACCEPTING GRANT DEED FROM SHEA HOMES FOR THREE PARCELS AND DECLARING CERTAIN PARCELS SURPLUS WHEREAS, at its meeting of April 5, 1988, Council reviewed the staff report (SR 88:127) recommending the vacation of a portion of open space in Tract 5680, more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the above-referenced property was dedicated to the City and has not been used by the City nor does the City anticipate a future use for the property; and WHEREAS, Shea Homes has offered to dedicate three parcels to the City in exchange for vacation of the above property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Based upon the above stated findings establishing that the property is not required by the City of Pleasanton, the parcels described in Exhibit "A" are hereby declared as surplus. Section 2: The City determines that the market value for the property is $1.00. Section 3: That from and after the date the resolution is effective, the property shall be sold for the above-stated market value. Section 4: The City finds that the most appropriate development pattern for the area is for use as plottage to the adjacent parcels, provided that the owners of the adjacent parcels are willing to pay the fair market value as stated above. Section 5: The City Manager is authorized to execute all documents to complete the sale of the surplus parcels. Section 6: The deed from Shea Homes to the City of Pleasanton is hereby accepted and the appropriate City officers are instructed to take whatever action necessary to implement said acceptance. Section 7: This resolution shall become effective immediately upon its passage and adoption.
