CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-127 <br /> <br /> RESOLUTION ACCEPTING GRANT DEED FROM SHEA HOMES FOR <br /> THREE PARCELS AND DECLARING CERTAIN PARCELS SURPLUS <br /> <br />WHEREAS, at its meeting of April 5, 1988, Council reviewed the <br /> staff report (SR 88:127) recommending the vacation of a <br /> portion of open space in Tract 5680, more particularly <br /> described on Exhibit "A" attached hereto and <br /> incorporated herein by this reference; and <br /> <br />WHEREAS, the above-referenced property was dedicated to the City <br /> and has not been used by the City nor does the City <br /> anticipate a future use for the property; and <br /> <br />WHEREAS, Shea Homes has offered to dedicate three parcels to the <br /> City in exchange for vacation of the above property; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Based upon the above stated findings establishing <br /> that the property is not required by the City of <br /> Pleasanton, the parcels described in Exhibit "A" are <br /> hereby declared as surplus. <br /> <br />Section 2: The City determines that the market value for the <br /> property is $1.00. <br /> <br />Section 3: That from and after the date the resolution is <br /> effective, the property shall be sold for the <br /> above-stated market value. <br /> <br />Section 4: The City finds that the most appropriate development <br /> pattern for the area is for use as plottage to the <br /> adjacent parcels, provided that the owners of the <br /> adjacent parcels are willing to pay the fair market <br /> value as stated above. <br /> <br />Section 5: The City Manager is authorized to execute all <br /> documents to complete the sale of the surplus parcels. <br /> <br />Section 6: The deed from Shea Homes to the City of Pleasanton <br /> is hereby accepted and the appropriate City officers are <br /> instructed to take whatever action necessary to <br /> implement said acceptance. <br /> <br />Section 7: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
