After discussion, it was moved by Councilmember Kephart, and seconded by <br />Councilmember Mohr, that Resolution No. 80-297, to grant the variance and to deny <br />the appeal of the City Council of a decision of the Board of Adjustment in approv- <br />ing the application of Mr. and Mrs. Robert Vaughn for a variance to Section 2-5.35 <br />of Article 3, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton <br />to allow the construction of a room addition which would encroach into the required <br />rear yard at their residence at 4950 Black Avenue, the property is zoned R-1-6500 <br />(Single-Family Residential) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmember Kephart and Mayor Mercer <br />NOES: Councilmembers Butler, Mohr, and Wood <br />ABSENT: None <br /> <br />Appeal of Mr. and Mrs. Robert Zie~ler of a decision of the Board of Adjustment <br />~nyin~ a variance to Section 2-5.35 of Artic!e. 3~ Chapter 2, Title II of the <br />Ordinance Code of the City of Pleasanton to allow the construction of a room <br />addition which would encroach into the required rear yard at their residence <br />located at 6244 Robin Court. Open from 10-28-80) <br /> Mr. Harris presented his report (SR 80:348) dated November 19, 1980, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the continued public hearing open on this item. <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 80-298, to deny the appeal of Mr. and Mrs. Robert Ziegler of a deci- <br />sion of the Board of Adjustment denying a variance to Section 2-5.35 of Article 3, <br />Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow the <br />construction of a room addition which would encroach into the required rear yard <br />at their residence located at 6244 Robin Court, the property is zoned R-1-6500 <br />(Single-Family Residential) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Wood <br />NOES: Councilmember Kephart and Mayor Mercer <br />ABSENT: None <br /> <br /> Mayor Mercer and Councilmember Kephart stated they felt it was punative of the <br />City Council not to approve these two variances because of possible increased costs <br />of construction, and it was not being responsive to the homeowners in light of <br />action taken earlier by CounciI to initiate an ordinance to amend the rear yard <br />setback requirements. <br /> <br /> Councilmember Butler stated there were insufficient findings under State Code <br />at this time to grant the variances therefore Council had no choice but to deny <br />the applications. <br /> <br />Application of Foothill Associates to rezone the approximately 9±acre parcel <br />located on Foothill Road south of Foothill High School at Muir~ood Drive South <br />from "A" (Agricultural) District to the R-1-20,O00 (.Single-Family Residential) <br />District.
