He advised that PG&E and PT&T concurred with the modifications. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Ordinance No. 946, to be read by title only and waiving further reading thereof, <br />amending Title IV by adding Chapter 9 (Noise Regulation) and amending Title I, <br />Chapter 1, Section 1-1.15 making violations of each chapter an infraction, as <br />modified in Staff Report 80:331, be re-introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Discussion of K-9 Defecation Ordinance <br /> Mr. Levine presented his report (SR 80:330) dated November 13, 1980, regarding <br />this matter. <br /> <br /> Councilmember Kephart stated he was not opposed to the intent of the proposed <br />ordinance but had grave concerns regarding enforcement of such an ordinance, adding <br />that he felt the police department has more pressing problems than to observe dogs <br />defecating on public property. He stated he felt it would create neighborhood <br />problems. Councilmember Kephart suggested a curbing ordinance as a better way to <br />control this problem. <br /> <br /> Mayor Mercer stated he was concerned about City parks and felt there should be <br />some type of control in an attempt to alleviate this problem. He stated he felt <br />seeing eye dogs should be exempt from the proposed ordinance. <br /> <br /> Councilmember Butler stated he was opposed to the proposed ordinance because <br />he felt there would be enforcement problems and that this is another example of <br />government regulation in areas where it does not belong. <br /> <br /> It was moved by Mayor Mercer, and seconded by Councilmember Wood, that Ordinance <br />No. 950 be read by title only and waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> After further discussion, it was moved by Mayor Mercer, and seconded by Council- <br />member Wood, that Ordinance No. 950, adding Section 4-5.25 (Canine Defecation) to <br />Article 3, Chapter 3, Title IV and amending Section 1-1.11 of Chapter 1, Title I <br />to make violations of certain sections of the Ordinance Code infractions, and <br />exempting seeing eye dogs and stating that defecation not be allowed to be dis- <br />posed of in public receptacles, be introduced. <br /> <br /> s. ll/17/SO <br /> <br /> <br />
