The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> Matters for the Information of the Council <br /> Mr. Walker presented his Information Report dated August 20, 1980, regarding <br />overweight trucks and spillage on City streets. Councilmember Kephart stated he <br />disagreed with the report that stated "most spillage onto City streets is the <br />result of gravel that has been accidentally dumped on the framework of trailers <br />during the loading operation", and added this does not excuse the spillage of gravel <br />onto City streets. He stated he also did not agree that 95% of gravel trucks are <br />carrying loads within legal limits. Mayor Mercer stated that there is a method of <br />gravel truck washing before traveling onto streets, and he requested the City <br />Manager to check with the gravel companies to see that they are doing this. <br /> <br /> Mr. Walker' presented the Information Report of the Director of Finance dated <br />August 20, 1980, regarding the process for selecting the City's Insurance Carriers <br />and Policies. Councilmember Kephart stated he had some questions regarding this <br />matter and would meet with the City's insurance broker on this item. <br /> <br />A~c.eptance of Improvements for Tract 4119, ~.~ntageHills <br /> Mr. Schaumburg presented his report dated July 15, 1980, regarding this matter. <br /> <br /> Councilmember Wood stated he had concerns regarding the developer and felt that <br />further development should not be approved until such time as problems with present <br />developments have been resolved. <br /> <br /> Mayor Mercer asked if the City could legally hold up this development until <br />former complaints are taken care of by the developer. The City Attorney advised <br />the City could not do this. <br /> <br /> Councilmember Wood stated the City has a debt to the homeowners and should do <br />whatever possible to take care of problems with developers. <br /> <br /> Councilmember Kephart stated he felt the City should have some kind of assurance <br />from H. C. Elliott that they are attempting to get their problems taken care of, and <br />he requested a report on the status of this situation. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Kephart, to continue the Acceptance of Improvements for Tract 4119, Vintage <br />Hills, for thirty days or until the City receives assurance from H. C.
