It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that ~rdinance No. 933, to be read by title only and waiving further reading thereof, approving the application of Amador Valley Investors to rezone from the R-1-6500 (Single-Family Residential) District to the PUD (Planned Unit Development) District and development plan approval for a 34-1ot, single-family residential subdivision proposed to be built on an approximately 9 acre parcel located on the south side of Fairlands Drive opposite its intersection with Brockton,Drive, and amending the Zoning Map of the City of Pleasanton accordingly, be introduced. Mayor Mercer declared the continued public hearing open. No one in the audience spoke in favor of or in opposition to this item. Mayor Mercer declared the public hearing closed. Mayor Mercer noted that no sewer capacity has been reserved for this project and that the Environmental Assessment should be so noted. It was moved by Councilmember Wood, and seconded by Councilmember Kephart, that Resolution No. 80-120, determining on the basis of a review of initial environmental study done for this project, that no significant environmental impact would occur as outlined in the City's guidelines and that a Negative Declaration is appropriate for the annexation of Annexation No. 78 - Fromm, be adopted. The roll call vote was as follows: AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer NOES: None ABSENT: Councilmember Butler It was moved by Councilmember Wood, and seconded by Councilmember Kephart, that Resolution No. 80-121, declaring no protests received from owners of land in the territory for Annexation No. 78 - Fronan, and ordering annexation subject to a con- dition that no sewer capacity has been reserved or set aside for this property, be adopted.
