He stated the purpose of this agreement is to give the <br />developer reasonable assurance that a project can be constructed in the current <br />zoning. He requested the following changes be made to the draft agreement: (1) <br />That the 7~ acre site on the east side of Foothill Road between Stoneridge Drive <br />and Laurel Creek Way be deleted from coverage by the agreement and that Exhibits <br />B, B-1 and D-2 be modified to reflect that deletion and Exhibits B-2 and B-3 be <br />renumbered; and (2) That Exhibit B-2 be modified to show parcel 2 divided into <br />two 2-acre sites and that Exhibit D-2 be modified to read'that westerly of these <br />two sites not obtain building permits prior to January 1, 1983, and the easterly of <br />the two sites not receive building permits prior to July 1, 1982. <br /> <br /> No one in the audience spoke in oppoe~tion to this item. <br /> <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> Councilmember Mohr expressed concern regarding the ten year time frame, in light <br />of the rapidly changing conditions of the City. <br /> <br /> After discussion. it was moved by Mayor Mercer, and seconded by Councilmember <br />Wood, that Ordinance No. 983. to be read by title only and waiving further reading <br />thereof, approving the application of the Taubman Company, Inc., for development <br />agreement for the following parcels of land: (1) The 43.9+ acres consisting of the <br />eastern and western portion of the area surrounded by Stoneridge Mall Road (Assessor's <br />Parcel 941-1201-30); (2) 4~ acre site on the north side of StoneridgeMall Road adja- <br />cent to Highway 580 (a portion of Assessor's Parcel 941-1201-33); and (3) A .9+ acre <br />site located at the southwest corner of the intersection of Stoneridge Mall Ro~d and <br />Canyon Way (the development agreement would provide for the phasing of development of <br />the above listed sites as well as the assurance of existing zoning) as modified by <br />the applicant, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: Councilmember Kephart 9. 6/23/81 <br /> <br /> <br />
