Mr. LeVin~ presented h~s',ep0rt (SR 81:2i9) dated June 18. 1981, regarding this matter. Mayor Mercer declared the public hearing open. Mr. Robert Gibney, Attorney representing The Taubman Company, stated he concurred with the staff report. He stated the purpose of this agreement is to give the developer reasonable assurance that a project can be constructed in the current zoning. He requested the following changes be made to the draft agreement: (1) That the 7~ acre site on the east side of Foothill Road between Stoneridge Drive and Laurel Creek Way be deleted from coverage by the agreement and that Exhibits B, B-1 and D-2 be modified to reflect that deletion and Exhibits B-2 and B-3 be renumbered; and (2) That Exhibit B-2 be modified to show parcel 2 divided into two 2-acre sites and that Exhibit D-2 be modified to read'that westerly of these two sites not obtain building permits prior to January 1, 1983, and the easterly of the two sites not receive building permits prior to July 1, 1982. No one in the audience spoke in oppoe~tion to this item. Mayor Mercer declared the public hearing closed. Councilmember Mohr expressed concern regarding the ten year time frame, in light of the rapidly changing conditions of the City. After discussion. it was moved by Mayor Mercer, and seconded by Councilmember Wood, that Ordinance No. 983. to be read by title only and waiving further reading thereof, approving the application of the Taubman Company, Inc., for development agreement for the following parcels of land: (1) The 43.9+ acres consisting of the eastern and western portion of the area surrounded by Stoneridge Mall Road (Assessor's Parcel 941-1201-30); (2) 4~ acre site on the north side of StoneridgeMall Road adja- cent to Highway 580 (a portion of Assessor's Parcel 941-1201-33); and (3) A .9+ acre site located at the southwest corner of the intersection of Stoneridge Mall Ro~d and Canyon Way (the development agreement would provide for the phasing of development of the above listed sites as well as the assurance of existing zoning) as modified by the applicant, be introduced.
