There being no further testimony, Mayor Mercer declared the public hearing closed <br />on the application and the Negative Declaration. <br /> <br /> Mr. Harris stated the Negative Declaration was based on development of the entire <br />property and that the mitigating Negative Declaration is still appropriate and can be <br />used as long as the mitigating measures are still in effect. <br /> <br /> Mr. Harris presented the following two conditions which he recommended be added <br />to the conditions contained in Planning Commission Resolution No. 1936: <br /> <br /> 1. That prior to the submittal of improvement plans for the subdivision of <br /> the subject property, the developer shall fund (or participate in the <br /> funding of) a comprehensive water study of the north Pleasanton area to <br /> identify short and long-term improvements necessary to achieve adequate <br /> water supply and pressure, and in order to achieve timely completion of <br /> such improvements concurrent with the development of the subject site, the <br /> developers shall enter into an agreement to pay their appropriate share of <br /> the costof the water facilities necessary to serve the subject site, or <br /> made necessary due to the cumulative development in the north Pleasanton <br /> area. Improvements may be made via reimbursement agreement, assessment <br /> districts or benefit district as best meets the needs of the City and <br /> developer; <br /> <br /> 2. Since the subject property will be subdivided and some of the lots event- <br /> ually sold, the ordinance or abstract thereof approving case PUD-80-14, <br /> shall be recorded so that all future owners are apprised of the obliga- <br /> tions attached to the property. <br /> <br /> Councilmember Butler stated that the key to the potential traffic problems is to <br />require mitigation measures to maintain traffic control in the area in question by <br />requiring whatever reasonable conditions and by whatever methods that are necessary <br />for such control. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 81-31, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the Cityts guidelines if mitigating conditions are adopted, and that a <br />Negative Declaration is appropriate for development plan approval for the 60-acre <br />site located immediately south of Johnson Drive and about 700 feet west of Hopyard <br />Road for the most southeasterly portion of the property, the property is zoned PUD <br />(Planned Unit Development) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, and Wood <br />NOES: Mayor Mercer <br />ABSENT: None <br /> <br /> Mayor Mercer stated that recently the City Council had required an Environmental <br />Impact Report be done on the Fromm Property. He stated he felt the Reynolds and <br />Brown property will have a significant impact on the community and should Be .required <br />to prepare an Environmental Impact Report. He added that although a traffic study <br />had been done in this area there are other concerns that need analysis. <br /> <br /> Mr. Harris advised Council that Council action includes consideration of the <br />precise details of development of the 13 lots shown with building footprints, and <br />the two streets.
