There being no further testimony, Mayor Mercer declared the public hearing <br />closed on this item. <br /> <br /> Councilmember Kephart stated the City has more park land now than it can develop <br />or adequately maintain, therefore, he felt it would be a mistake to add any more <br />City park land. <br /> <br /> Councilmember Mohr stated that land is valuable and she felt this park land <br />dedication should be accepted with development to take place when funds are avail- <br />able, or allow the residents to improve and maintain the park. <br /> <br /> Councilmember Butler stated that no city can have a park in every neighborhood. <br />He added that the Park and Recreation Commission had disapproved a park in this area. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 81-33, to retain the dedication of lots 12 and 13 of Tract 4372 for <br />park purposes rather than accept in lieu park fees, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr and Wood <br />NOES: Councilmembers Butler, Kephart, and Mayor Mercer <br />ABSENT: None <br /> <br /> The City Attorney advised that the Tentative Map for Tract 4372 has not been <br />ftnalized, therefore Council could make changes if they so desired. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that no further action be taken on Tract 4372, since all concerns had been addressed <br />previou sly. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler and Kephart <br />NOES: Councilmembers Mohr, Wood, and Mayor Mercer <br />ABSENT: None <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, instruct- <br />ing staff to prepare a report regarding the concerns of Amber Lane relative to Tract <br />4372. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Wood, and Mayor Mercer <br />NOES: Councilmembers Butler and Kephart <br />ABSENT: None <br /> <br />Continuation of City Council Meeting <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Wood, to <br />continue the City Council meeting to the conclusion of the agenda, in conformance <br />with Council policy to determine at 11:30 P.M., whether or not to continue the <br />meeting. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Appeal of Crai~ Reali of a decision of the Board of. Ad3ustment deny~nM his applica- <br />tion for a variance to Section 2-5.41(6) of Article .3~ of the Ordinance Code of the <br />City of Pleasanton. to allow the retention of a patio cover which encroaches into the <br />required side yard setback of his propertX at 3968 Empire Court.
