Mr. Oliver AnJo, 2403 Raven Road, indicated he appreciated Mr. Dunkley's efforts <br /> and the City's need for housing, but in view of the possibility of losing the down- <br /> town Southern Pacific parks and the development of Happy Valley and surrounding area, <br /> he felt the land should be retained as a park and used for recreational development. <br /> Mr. Kephart indicated we now have 154 acres of undeveloped park land. <br /> <br /> Council recommended the matter be referred back to the City Attorney to prepare <br /> a report on the legal ramifications of dealing with the non-profit corporation. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, to <br /> authorize staff to begin negotiations and study regarding development of the low- <br /> cost housing on City-owned land. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> Request to Close Main Street for Christmas TreeLightin~ <br /> Mr. Walker presented the report of the Assistant to the City Manager (SR 81:418) <br /> dated November 24, 1981, regarding this matter. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Kephart, that <br /> Resolution No. 81-411, authorizing the closing of Main Street between 6:30 p.m., and <br /> 8:00 p.m., for the lighting of the Christmas Tree on December 2, 1981, and amending <br /> the budget by approximately $254.00 to reflect the increased overtime costs, be <br /> adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> Mayor Mercer recessed the meeting at 10:15 P.M. <br /> <br /> Mayor Mercer reconvened the meeting at 10:25 P.M. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Growth Management Implementation and Adoption of Ordinance No. 1006~ an urgency <br /> ordinance exemp. t.i. ng projects entering into agreement to participate in the mortgage <br /> revenue bond program of the City of Pleasanton from the requirements of the City <br /> Residential Allocation Program <br /> Mr. Walker presented his information report (IR 81:35) dated November 24, 1981, <br /> regarding outstanding Residential Allocation Program approvals and their affect on <br /> population benchmarks. He reviewed the proposed ordinance exempting projects from <br /> RAP which agree to participate in the bond program and briefly outlined those pro- <br /> jects which are ready to enter the bond program. <br /> <br /> Mhyor Mercer declared the public hearing open. <br /> <br /> Mr. Bill HiPst, 147 Bernal Avenue, presented the concerns of his client, Mr. <br /> Parfish, who has a project on Vineyard Avenue. He indicated he would like the word <br />"substantial" removed from Section 1 of Ordinance No. 1006. Mr. Parfish has been <br /> advised by the underwriters of the bond program that because he would be construct- <br /> ing factory built or mobile homes, for him to participate to an extent greater than <br /> 8-10 units would proJudice the City's bond rating and adversely affect the City's <br /> ability to market the bonds. Mr. Parrish would like an exemption from the Residen- <br /> tial Allocation Program or the Growth Management Plan even though he cannot partici- <br /> pate in a number greater than 8-10 units.
