· 435 <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Mohr, that <br /> Resolution No. 81-264, determining on the basis of a review of initial environmental <br /> study done for this project, that no significant environmental impact would occur as <br /> outlined in the City's guidelines and that a negative declaration is appropriate for <br /> Planned unit Development zoning and development plan approval for a 108 unit town- <br /> house project located on a 7.19 acre site immediately behind the shopping center on <br /> Pico Avenue between Tawny and Palomino Drives, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Council- <br /> member Kephart, that Ordinance No. 989, to be read by .title only and waiving further <br /> reading thereof, approving Case PUD-81-6, the application of Vintage Associates, Ltd., <br /> for Planned Unit Development zoning and development plan approval for a 108 unit <br /> townhouse project located on a 7.19 acre site immediately behind the shopping center <br /> on Pico Avenue between Tawny and Palomino Drives, the property is zoned PUD (Planned <br /> Unit Development-High Density Residential) District, subject to the 30 conditions of <br /> the staff report to the Planning Commission dated July 15, 1981, but deleting Condi- <br /> tion 31 added by the Planning Commission stating that there shall be no construction <br /> on the subject property until Pico Avenue is connected to Stanley Boulevard, be in- <br /> troduced. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that <br /> Resolution No. 81-265, after making the findings under lower income housing develop- <br /> ment, approve the request of Vintage Associates to exempt from the Residential Allo- <br /> cation Program, Case PUD-81-6, Vintage Terrace Condominiums 108-unit project adjacent <br /> to Flair Shopping Center, subject to making 20% of the units available as rentals for <br /> those of lower income (80% of the areawide median family income or less) for a period <br /> of seven years, and subject to making at least 12 units available for sale at.a price <br /> not to exceed $69,950 each, for first time entry level buyers, and postponing certain <br /> City permit fees until finalization of the houses, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> Council congratulated Mr. Heaton on his project. <br /> <br /> Application of the City of Pleasanton to amend Article 23 (non-conforming uses), <br /> Cha.p. ter 2~ Title II of the Ordinance Code of the C~ty of Pleasanton as it relates <br /> to the elimination of non-conformin~ uses~ ~tructures and signs <br /> <br /> On the basis of an Initial S~yof the potential environmental impac.ts of the . <br /> project, t~e Director of Planning an~ .Communi~ty' Development has determined that <br /> the proposed prpject would not have a~v potential significant adverse effects on <br /> the environment and that an environmental impact report need not be prepared. <br /> This Initi.al S.t~y is available for review at the Plannin,~ Divi~iop~ 200 Bernal <br /> Avenue~ ~l~a.santon.
