It was moved by Mayor Mercer, and seconded by Councilmember Kephart, that Reso- lution No. 82-124, supporting ACA 73 and SCA 48 for the reason that a public vote should be taken on the matter of whether Public Utility Commission commissioners should be elected, and directingstaff to forward this position to the area's legis- lators as well as the bill's authors and committee chairmen, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer NOES: None ABSENT: None PendinE Legislation regarding Diamond Lane Bill Mr. Swift presented his report (SR 82:130) dated April 1, 1982, regarding this matter. It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that Resolution No. 82-125, supporting AB 2313 relating to exclusive highway lanes, and directing staff to forward this resolution to Assemblyman Lockyer, Assemblyman Mar- guth, Senator Holmdahl, and the Chairman of the Ways and Means Committee, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer NOES: None ABSENT: None Status Report regarding Vicious Do~ Ordinance Mr. Swift presented his report (IR 82:12) dated April 1, 1982, stating that the draft ordinance will be presented at the meeting of April 27, 1982. COMMUNICATIONS Letter from Joe Madden re~ardin8 Shadow Creek Condominium Project Mayor Mercer presented a letter from Joseph Madden and Earl A. Adams, dated March 20, 1982, regarding low or moderate income set-aside for the Shadow Creek Condominium Project on Vineyard Avenue. After discussion, Council referred this letter to staff for review and recommendation. CITY COUNCIL CALENDAR Mr. Walker presented the Calendar for the information of the Council. EXECUTIVE SESSION Mayor Mercer recessed the meeting at 10:45 P.M., to an Executive Session to discuss pending litigation and labor relations. Mayor Mercer reconvened the meeting at 11:25 P.M. It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that Resolution No. 82-126, approving the Memorandum of Understanding with the Pleasanton City Employees Association for the period March 1, 1982 through February 28, 1984, be adopted.
