471 <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> ~ending Legislation regardin~ Public Utilities Commission <br /> Mr. Swift presented his report (SR 82:131) dated April 1, 1982, regarding this <br /> matter. <br /> <br /> It was moved by Mayor Mercer, and seconded by Councilmember Kephart, that Reso- <br /> lution No. 82-124, supporting ACA 73 and SCA 48 for the reason that a public vote <br /> should be taken on the matter of whether Public Utility Commission commissioners <br /> should be elected, and directingstaff to forward this position to the area's legis- <br /> lators as well as the bill's authors and committee chairmen, be adopted. <br /> The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> PendinE Legislation regarding Diamond Lane Bill <br /> Mr. Swift presented his report (SR 82:130) dated April 1, 1982, regarding this <br />matter. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 82-125, supporting AB 2313 relating to exclusive highway lanes, and <br />directing staff to forward this resolution to Assemblyman Lockyer, Assemblyman Mar- <br />guth, Senator Holmdahl, and the Chairman of the Ways and Means Committee, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Status Report regarding Vicious Do~ Ordinance <br /> Mr. Swift presented his report (IR 82:12) dated April 1, 1982, stating that the <br />draft ordinance will be presented at the meeting of April 27, 1982. <br /> <br />COMMUNICATIONS <br />Letter from Joe Madden re~ardin8 Shadow Creek Condominium Project <br /> Mayor Mercer presented a letter from Joseph Madden and Earl A. Adams, dated <br />March 20, 1982, regarding low or moderate income set-aside for the Shadow Creek <br />Condominium Project on Vineyard Avenue. After discussion, Council referred this <br />letter to staff for review and recommendation. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the Calendar for the information of the Council. <br /> <br />EXECUTIVE SESSION <br /> Mayor Mercer recessed the meeting at 10:45 P.M., to an Executive Session to <br />discuss pending litigation and labor relations. <br /> <br /> Mayor Mercer reconvened the meeting at 11:25 P.M. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that Resolution No. 82-126, approving the Memorandum of Understanding with the <br />Pleasanton City Employees Association for the period March 1, 1982 through February <br />28, 1984, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> 14. 4/6/82 <br /> <br /> <br />
