The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Wood <br /> <br /> Approval of Mitigation Measures Agreement for Foothill Investors <br /> Mr. Swift presented his report (SR 82:113) dated March 16, 1982, regarding this <br /> matter. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that <br /> Resolution No. 82-109, approving the Mitigation Measures Agreement for Foothill <br /> Investors, and authorizing the mayor to execute it, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br /> NOES: None <br />~ ABSENT: Councilmember Wood <br /> <br />T~ Status Report re~arding Drug Paraphernalia <br />CO Mr. Swift presented his report (SR 82:117) dated March 18, 1982, regarding this <br />~ matter. He stated he needs to review further bills in an attempt to avoid the pre- <br />~ emption issue, and that he is working with the Chief of Police in drafting an ordi- <br /> nance that will best withstand a test on pre-emption grounds. <br /> <br /> Councilmembers Butler and Kephart reiterated Council's strong position in favor <br /> of the prohibition of drug paraphernalia and related items, and indicated that they <br /> are vitally interested in doing whatever can be done within the law to control the <br /> sale of drug paraphernalia, and would support enacting an ordinance as soon as pos- <br /> sible. <br /> <br /> Status Report on PG&E Rate Increase <br /> Mr. Swift presented his report (SR 82:120) dated March 18, 1982, regarding this <br /> matter. <br /> <br /> Mr. Oliver Anjo, 2403 Raven Road, thanked Mr. Swift for the research he has done <br /> on this issue. Mr. AnJo requested that Council support the Alameda County Board of <br /> Supervisors resolution that requests the Public Utilities Commission to re-open and <br /> review the new Pacific Gas and Electric rate structure. He asked that Council also <br /> aupport Assemblyman Katz's resolution that the Public Utilities Commission hold its <br /> meetings concerning increases or other adjustments in rates, open and public in <br /> accordance with the spirit and intent of Section 306 of the Public Utilities Code, <br /> and that the commission suspend all electric and gas rate increases approved since <br /> January 1, 1982, and reinstitute the rate structure in effect as of that date until <br /> the Auditor General can complete a management investigation of Pacific Gas and Electric <br /> Company. He reiterated his concern regarding the appointment of Public Utilities <br /> Commissioners, stating he felt they should be elected by the voters. <br /> <br /> Councilmember Mohr stated she recently artended a meeting on the Aging, and heard <br /> their desperate plea for lower utility rates, therefore she would support the Board <br /> of Supervisors resolution. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, to <br /> support the Alameda County Board of Supervisors resolution requesting the Public <br /> Utilities Commission to re-open and review the new Pacific Gas and Electric rate <br /> structure. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Kephart and Mohr <br /> NOES: Councilmember Butler and Mayor Mercer <br /> ABSENT: Councilmember Wood <br /> <br /> 12. 3/23/82 <br /> <br /> <br />
