Open from 6-22-82 and 7-13-82) <br /> Mayor Butler stated this item has been continued open from the City Council meet- <br />ings of June 22, 1982, and July 13, 1982, and it was now in order to take testimony <br />on the matter. He stated the purpose of the proposed rezoning is to bring the pro- <br />perty into conformance with the General Plan. <br /> <br /> Mr. Finney, representing the Roman Catholic Church of Oakland, stated that he <br />had not received proper notification regarding this item because of an error in <br />mailing address. He stated there had also been confusion regarding inclusion of <br />the Church's property in the original General Plan amendment application. Mr. Finney <br />requested the item be continued to allow ample review by the Church and for their <br />input regarding this matter. He stated the Church does not intend to sell the land <br />for high density housing. <br /> <br /> Council discussion ensued regarding referring this item back to the Planning <br />Commission to allow Mr. Finney to make a presentation to this body and for their <br />further review relative to their decision on the matter. Mr. Glenn advised that <br />the Planning Commission could consider this item at their second meeting in Septem- <br />ber. Mr. Glenn also advised that a General Plan amendment would be necessary. <br /> <br /> After further discussion, Mayor Butler declared the public hearing application <br />of the City of Pleasanton to rezone approximately 13 acres of land located onthe <br />south side of Bernal Avenue extension between the eastern side of the right-of-way <br />of the Western Pacific Railroad Company and the eastern side of the right-of-way of <br />the Southern Pacific Transportation Company from the "O" (Office) and "I-P" (Indus- <br />trial Park) District and to prezone approximately 16 acres adjacent and to the south <br />for a total of approximately 29 acres to the PUD (Planned Unit Development)-High <br />Density Residential District or to any other zoning district consistent with the <br />General Plan, and the accompanying negative declaration, continued to the City Council <br />meeting of October 12, 1982, 8:00 P.M., Pleasanton Council Chambers; with review by <br />the Planning Commission on September 22, 1982. <br /> <br />Ascertain whether the public necessity. health, safety or welfare requires the <br />removal of poles~ overhead wiresA and associated overhead structures and the <br />underground installation of wires and facilities for supplying electric, com- <br />munication or similar associated service within Underground Utility District <br />82-1 on Hopyard Road between Valley Avenue and Arroyo Mocho <br /> Mr. Warnick presented his report (SR 82:274) dated July 18, 1982, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to the item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, that <br />Resolution No. 82-272, establishing Underground Utility District 82-1 on Hopyard <br />Road between Valley Avenue and Arroyo Mocho, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Brandes <br /> <br /> 3. 7/27/82 <br /> <br /> <br />
