235 I: , MINUTES of THE MEETING of THE CITY COUNCIL August 23, 1983 CALL TO ORDER Mayor Robert Butler called the Regular Meeting of the City Council to order at 8:00 P.M., and then led the Pledge of Allegiance to the flag. ROLL CALL Deputy City Clerk Doris George called the roll which is recorded as follows: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler were present. Mr. Walker, City Manager, Mr. MacDonald, City Attorney, Mr. Warnick, Director of Public Works and Utilities, Mr. Harris, Director of Planning and Community Development, Mr. Okamura, Assistant City Engineer, Mr. Miller, Assistant to the City Manager, and Mrs. Wagner, Director of Finance, were present. AGENDA AMENDMENTS Mr. Walker requested that an item be added to the agenda as item 4s - Approval of Claims; Review of Financial Reports~ July, 1983. Mr. Walker requested that item 4o - Award of Bid for Contract to Publish City's Legal Notices for Fiscal Year 1983-84, be moved on the agenda to item 12e, as re- quested by the Tri-Valley Herald. Mr. Walker requested that item 41 - Review and Approval of Final Map, Improve- ment Plans, Deferred Traffic Signal Improvement Agreement and Subdivision Agreement for Tract 5094 - Springwood Meadows, Barratt, San Jose, be moved on the agenda to item 12f, at the request of Councilmember Brandes. Mr. Walker requested that an item be added to the agenda as item 12g - Pleasanton Chamber of Commerce Heritage Days Permit Application. Mr. Walker advised there would be an Executive Session held at the conclusion of this meeting to discuss pending litigation. Mr. Lee Henderson requested that item 4g - Approval of Final Map and Improvement Plans and Agreement for Tract 4940, Deer Oaks, Phase II, Deer Oaks Land Company, be removed from the Consent Calendar for discussion. After Council discussion, item 4g was moved to item 12h on the agenda. CONSENT CALENDAR It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that the following items listed on the Consent Calendar, as amended thereto, be approved: a. Approval of City Council Minutes for 8-9-83. Councilmember Mercer abstained from voting on this item because of his absence from the meeting. b. Proclaim week of September 11-18, 1983 as "Heritage Days 1983". c. Adoption of Resolution No. 83-348, denying the claim of Alameda County Flood Con-~ trol and Water Conservation District in the sum of $10,000. This claim arises out of the lawsuit of Chris Beratlis in which the City of Pleasanton, Alameda County Flood Control and Water Conservation District and Southern Pacific are named de- fendants. Alameda County is seeking indemnity from the City for any damages which may be assessed to them.
