235 I: , <br /> <br /> MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> August 23, 1983 <br /> <br />CALL TO ORDER <br /> Mayor Robert Butler called the Regular Meeting of the City Council to order at <br />8:00 P.M., and then led the Pledge of Allegiance to the flag. <br /> <br />ROLL CALL <br /> Deputy City Clerk Doris George called the roll which is recorded as follows: <br />Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler were present. Mr. <br />Walker, City Manager, Mr. MacDonald, City Attorney, Mr. Warnick, Director of Public <br />Works and Utilities, Mr. Harris, Director of Planning and Community Development, <br />Mr. Okamura, Assistant City Engineer, Mr. Miller, Assistant to the City Manager, <br />and Mrs. Wagner, Director of Finance, were present. <br /> <br />AGENDA AMENDMENTS <br /> Mr. Walker requested that an item be added to the agenda as item 4s - Approval <br />of Claims; Review of Financial Reports~ July, 1983. <br /> <br /> Mr. Walker requested that item 4o - Award of Bid for Contract to Publish City's <br />Legal Notices for Fiscal Year 1983-84, be moved on the agenda to item 12e, as re- <br />quested by the Tri-Valley Herald. <br /> <br /> Mr. Walker requested that item 41 - Review and Approval of Final Map, Improve- <br />ment Plans, Deferred Traffic Signal Improvement Agreement and Subdivision Agreement <br />for Tract 5094 - Springwood Meadows, Barratt, San Jose, be moved on the agenda to <br />item 12f, at the request of Councilmember Brandes. <br /> <br /> Mr. Walker requested that an item be added to the agenda as item 12g - Pleasanton <br />Chamber of Commerce Heritage Days Permit Application. <br /> <br /> Mr. Walker advised there would be an Executive Session held at the conclusion of <br />this meeting to discuss pending litigation. <br /> <br /> Mr. Lee Henderson requested that item 4g - Approval of Final Map and Improvement <br />Plans and Agreement for Tract 4940, Deer Oaks, Phase II, Deer Oaks Land Company, be <br />removed from the Consent Calendar for discussion. After Council discussion, item 4g <br />was moved to item 12h on the agenda. <br /> <br />CONSENT CALENDAR <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that the <br />following items listed on the Consent Calendar, as amended thereto, be approved: <br /> <br />a. Approval of City Council Minutes for 8-9-83. Councilmember Mercer abstained from <br /> voting on this item because of his absence from the meeting. <br /> <br />b. Proclaim week of September 11-18, 1983 as "Heritage Days 1983". <br /> <br />c. Adoption of Resolution No. 83-348, denying the claim of Alameda County Flood Con-~ <br /> trol and Water Conservation District in the sum of $10,000. This claim arises out <br /> of the lawsuit of Chris Beratlis in which the City of Pleasanton, Alameda County <br /> Flood Control and Water Conservation District and Southern Pacific are named de- <br /> fendants. Alameda County is seeking indemnity from the City for any damages which <br /> may be assessed to them. <br /> <br /> <br />
