Mr. Magaro, representing Duran Jones Construction Company, stated this firm is also willing to make the commitment to hold harmless and indemnify and defend the City of Pleasanton should any litigation result from the approval of award of con- tract to them. After discussion, it was moved by Councilmember Mercer, and seconded by Council- member Mohr, that Resolution No. 83-132, after hearing and considering all testimony presented, permitting the substitution of subcontractors as requested by Bay Cities Paving, be adopted.
