Mr. Magaro, representing Duran Jones Construction Company, stated this firm is <br /> also willing to make the commitment to hold harmless and indemnify and defend the <br /> City of Pleasanton should any litigation result from the approval of award of con- <br /> tract to them. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearin~ closed <br /> on this item. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br /> member Mohr, that Resolution No. 83-132, after hearing and considering all testimony <br /> presented, permitting the substitution of subcontractors as requested by Bay Cities <br /> Paving, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mercer, Mohr, and Mayor Butler <br /> NOES: Councilmember Wood <br /> ABSENT: Councilmember Brandes <br /> <br /> Mr. Robert Brunsell, Bond Counsel, stated that it was now in order to hold the <br /> public hearing on the Fromm Business Park, Assessment District 1982-5. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, that <br />the following resolutions in connection with Fromm Business Park, Assessment District <br />1982-5, be adopted: (1) Resolution No. 83-133, approving report and assessment; (2) <br />Resolution No. 83-134, establishing bond reserve fund; (3) Resolution No. 83-135, <br />concerning foreclosure of delinquent assessment liens; (4) Resolution No. 83-136, <br />authorizing changes; (5) Resolution No. 83-137, ordering sale of bonds; (6) Resolu- <br />tion No. 83-138, awarding contract; (7) Resolution No. 83-139, determining assess- <br />ments remaining unpaid; and (8) Resolution No. 83-140, appointing paying agent. <br />The roll call vote was as ~ollows: <br />AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmembers Brandes <br /> <br />Plan relating to construction on Santa Rita Road, consisting of the construction of <br />a three-lane width bridge over the Arroyo Mocho and related improvements <br /> <br />Consider Adoption of Negative Delcaration <br /> Mr. Warnick presented his report (SR 83:125) dated April 6, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the mitigated <br />negative declaration. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Wood, that <br />Resolution No. 83-141, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a mitigated negative declaration is appro- <br />priate for plan relating to construction on Santa Rita Road, consisting of the con- <br /> <br /> 9. 4/12/83 <br /> <br /> <br />
