AJplication of the Ci~_y of Pleasanton to amend Articles 2 (Definitions) and 8 ('C' <br />Commercial Districts)~ Chapter 2~ Title II of the Ordinance Code of the City of <br />Pleasanton with regard to game arcades <br /> Mr. Harris presented his report (SR 83:33 dated January 18, 1983, regarding <br />this matter. <br /> <br /> Council discussion ensued relative to penalties if a child is caught violating <br />the regulations of the ordinance, and why the number four (4) or more commercial <br />amusement devices was used instead of one, two, or three. <br /> <br /> Mayor Butler declared the public hearing open on this i~em. <br /> <br /> Mr. Brad Hirst, 2456 Minivet Court, complimented staff on the report. He was <br />pleased with the deletion of a requirement that game arcades be 600 feet from schools. <br />He also suggested that Section 4-4.25 (b) be changed from "All amusement devices in <br />public places shall be under the reasonable supervision of an employee on the pre- <br />mises..." to read "All amusement devices in public places shall be in full view of <br />an employee on the premises...". He suggested that Section 4-4.25 (e) be changed <br />from "No amusement device shall be located outside of any structure...", to "No <br />amusement device shall be located outside of any building .... Mr. Hirst stated <br />there is no magic number for machines; the more important issue being the access- <br />ibility to the machines, the type of acility being more important than the number <br />of machines. <br /> <br /> Mr. Doug Krutilek, Manager of Pizza Time Theatre, stated he is in favor of the <br />zoning requirements and standards set up by the Planning Commission. He stated he <br />only has one comment regarding the ordinance, under Section 4-4.25 (d) relative to <br />the provision of bicycle racks. He stated this would encourage minors to come to <br />his place of business without being accompanied by an adult, which is prohibited in <br />his establishment. He stated it would also be a hardship to install 180 bike racks <br />in front of his business. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that <br />Ordinance No. 1071, to be read by title only and waiving further reading thereof, <br />related to amusement devices and game arcades amending Section 2-5.20, Article 2, <br />(Definitions) and Section 2-7.80 (Permitted and Conditional Uses), Article 8 ('C' <br />Commercial Districts), Chapter 2 (Zoning), Title II (Zoning and Development) of the <br />Ordinance Code of the City of Pleasanton, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Brandes, that Ordinance No. 1072, to be read by title only and waiving further <br />reading thereof, relating to amusement devices and amending in its entirety Article II <br />(Pinball Machines), Chapter 2 (Special Permits), Title IV (Health, Safety, Morals and <br />General Welfare) of the Ordinance Code of the City of Pleasanton, but changing Section <br />1. (d) from (4) or more commercial amusement devices to two (2) or more commercial <br />amusement devices; changing Section 4-4.25 (b) to read "All amusement devices in pub- <br />lice places shall be in direct line of sight of supervision of an employee on the <br />premises responsible for the operation of the devices at all times"; add a sentence <br /> <br /> 7. 1/25/83 <br /> <br /> <br />
