Councilmember Wood discussed the Brown Act. He advised he has asked for copies <br />of Senator Keen's bill from his office, which Council can review at a later date. <br /> <br /> Councilmember Wood asked when the trash from Albers Warehouse building would be <br />removed. The Chief Building inspector advised it would be removed within 15 days. <br /> <br /> Councilmember Prandes asked if there was a definite date for the West Las Positas <br />Overcrossing opening, indicating flimsy blockades were a problem. Mr. Warnick said <br />better blockades will be provided, and that PG&E will be completed with their work <br />this week. Official ceremony should be next week. <br /> <br /> Mayor Mercer stated that opposition continuesto the quarry on Foothill Road. <br />Council unanimously agreed to send another letter to the County reiterating the <br />City's opposition to the operation of the quarry on Foothill Road. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> There were no City Council Committee Reports presented at this meeting. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Mr. Richard Rebholz, 1951 Foxswallow Circle, stated that he is concerned with the <br />Valley Plaza Apartment Project. He is concerned that taxpayers money is being used <br />for no parking signs, that trees are being removed unnecessarily. He questioned <br />whether Council was familiar with this area. Mayor Mercer stated he lives down the <br />street and is very familiar with the project. It was his understanding that one or <br />two trees were removed accidentally. Mr. Rebholz said four trees were to be left, <br />all seven trees were heritage trees. He questioned why Council would let trees be <br />taken down so more apartment house units could be put in. Mr. Rebholz indicated that <br />the plans were changed and the building is now 14' closer to him with a stairway.to <br />the apartment up at the top. He was never notified of changes in the plans. He is <br />particularly concerned about privacy into his backyard, and has had to buy new blinds. <br />On March 9, 1983, at the City Council Meeting, he was asked if he would like to have <br />two twelve foot trees to replace seven sixty foot trees. He declined, the Council <br />closed the matter and voted. He felt the developer should be responsible for putting <br />back those seven sixty foot trees. He has now, at this point, been offered six twelve <br />foot trees. The apartment house is forty feet high and he feels that these trees <br />would offer no privacy. He indicated he has a two story house and that Larry Lindsey, <br />Planning Commissioner, has a one story house; Mr. Lindsey is 114' away from the unit, <br />Mr. Rebholz is 30' away from it -- he does not think this is very justifiable. He <br />indicated that if something wasn't done as he has asked; to take that one building <br />out, to put it back where it belongs, then he has full intentions at this time to go <br />ahead and sue the City for the wrongdoings that have happened to him. He made another <br />comment in regard to the City of Pleasanton having bonds for $7,960,000.00 to finance <br />this project through First Nationwide Savings program so that they can give a lower <br />interest rate to the developer to put in 32 units of low cost housing. He stated he <br />was told there would only be top quality built apartments and top quality people <br />living in those apartments, and nothing was to be under-privilege or low cost housing. <br />He stated that Moggy Mogenson came to his home and showed him exactly how the plan <br />had been changed. <br /> <br /> Mayor Mercer was concerned and indicated this matter should be looked into. As <br />he remembers there was quite a bit of discussion about the last unit, that it should <br />not look into Mr. Rebholz's backyard. Mr. Rebholz again questioned why the City <br />would use bond money to finance a project like this instead of using money to repair <br />the streets. Mr. Walker indicated that the City was not putting up any of that money, <br />it is a program that the Federal Government has to aid in the housing projects, and <br />it makes money available at a lower interest by selling tax exempt bonds. The City <br />is not standing any liability for the bonds, there is no tax money related to it at <br />all.
