Mayor Mercer declared the public hearing open on the application and the negative declaration. Mr. Anthony Vasallo, 2884 Foothill Road, stated the application is a request for a lot split in order to build another house on the property. No one in the audience spoke in opposition to this item. There being no further testimony, Mayor Mercer declared the public hearing closed on the application and the negative declaration. It was moved by Councilmember Brandes, and seconded by Councilmember But- ler, that Resolution No. 85-246, determining on the basis of a review of ini- tial environmental study done for this project, that no significant environ- mental impact would occur as outlined in the City's guidelines and that a negative declaration is appropriate in connection with RZ-85-9, application of Anthony Vasallo to rezone an approximately 1.96 acre site located at 2884 Foothill Road from the "All (Agricultural) to the R-1-40,OOO (Single-family Residential) District, be adopted. The roll call vote was as follows: AVES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmember Wood It was moved by Councilmember Brandes, and seconded by Councilmember But- ler, that Ordinance No. 1199, to be read by title only and waiving further reading thereof, approving RZ-85-9, application of Anthony Vasallo to rezone an approximately 1.96 acre site located at 2884 Foothill Road from the "A" (Agricultural) to the R-1-40,000 (Single-family Residential) District, be introduced. The roll call vote was as follows: AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmember Wood MATTERS CONTINUED FOR DECISION Adoption of Ordinance No. 1164, Amending Chapter 7 of Title V by adding Arti- cle 2 (Removal of Vehicles from Private Property) Mayor Mercer stated that Ordinance No. 1164 was introduced on April 16, 1985, by a vote of 4-Ayes, I-Absent, and it was now in order to adopt the ordinance. It was moved by Councilmember Brandes, and seconded by Councilmember But- ler, that Ordinance No. 1164, amending Chapter 7 of Title V by adding Article 2 (Removal of Vehicles from Private Property), be adopted.
