<br /> <br />-"'~""'-'....--......~ <br /> <br /> <br />.367 <br /> <br /> <br /> <br />~ <br />~ <br />LD <br />W <br />CD <br /><( <br /> <br />40,000 (Single-family Residential) zoning district or to any other zoning dis- <br />trict consistent with the General Plan <br /> <br />Consider Adoption of Negative Declaration <br />Mr. Harris presented his report (SR 85:239) dated May 7, 1985, regarding <br />this matter. <br /> <br />Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br />Mr. Anthony Vasallo, 2884 Foothill Road, stated the application is a <br />request for a lot split in order to build another house on the property. <br /> <br />No one in the audience spoke in opposition to this item. <br /> <br />There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br />It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 85-246, determining on the basis of a review of ini- <br />tial environmental study done for this project, that no significant environ- <br />mental impact would occur as outlined in the City's guidelines and that a <br />negative declaration is appropriate in connection with RZ-85-9, application of <br />Anthony Vasallo to rezone an approximately 1.96 acre site located at 2884 <br />Foothill Road from the "All (Agricultural) to the R-1-40,OOO (Single-family <br />Residential) District, be adopted. <br />The roll call vote was as follows: <br />AVES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Ordinance No. 1199, to be read by title only and waiving further <br />reading thereof, approving RZ-85-9, application of Anthony Vasallo to rezone <br />an approximately 1.96 acre site located at 2884 Foothill Road from the "A" <br />(Agricultural) to the R-1-40,000 (Single-family Residential) District, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1164, Amending Chapter 7 of Title V by adding Arti- <br />cle 2 (Removal of Vehicles from Private Property) <br />Mayor Mercer stated that Ordinance No. 1164 was introduced on April 16, <br />1985, by a vote of 4-Ayes, I-Absent, and it was now in order to adopt the <br />ordinance. <br /> <br />It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Ordinance No. 1164, amending Chapter 7 of Title V by adding Article <br />2 (Removal of Vehicles from Private Property), be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />- 13 - <br /> <br />5-7-85 <br />
