He did not feel this was an appropriate <br /> rule. <br />~ Mr. Doug Bosma, representing Clorox, 7200 Johnson Drive, stated he is con- <br />/.[-) cerned about the increased estimate of costs for some property included in the <br /> Assessment District. He advised that about one year ago he found out that <br />~ approximately 6 acres of their property was included in the North Pleasanton <br />=~) Improvement District boundaries through the Design Review process. He stated <br />~ that the assessment costs are considerably higher than first estimated. He <br />~ asked that this matter be continued to allow for discussion with the City <br /> regarding this property. <br /> <br /> Mayor Mercer asked for a legal opinion by the Bond Counsel. Mr. Brunsell <br /> stated he could not challenge the fact that both Valley Memorial Hospital and <br /> Kaiser Foundation Health are non-profit corporations, exempt under Section <br /> 501(c)(3) of the Internal Revenue Code and under the California Revenue and <br /> Taxation Code. He advised that the regulatory process is different for these <br /> hospitals; it is essential that Valley Memorial shows community support and <br /> that local people govern it. Mr. Brunsell stated that regard to the cost es- <br /> timates, construction bids on the roadway work have come in below estimates, <br /> therefore there will be a surplus, which will be credited to the property <br /> owners. He reviewed the billing process, which will not begin until December <br /> 1986. <br /> <br /> Mr. Zullo advised that at the time the Assessment District was formed that <br /> a parcel owned by Alameda County Flood Control was included in ths District <br /> but has since been reduced to 0 assessment. He stated that all costs have <br /> been thoroughly reviewed and before making any disbu sements they will be cer- <br /> t'.,'ied. He advised that when the District was formed it was not known who <br /> would dedicate right-of-way so land acquisition was included in the cost esti- <br /> mates, but if land was dedicated 'hen costs could be kept down. Some property <br /> owners refused to dedicate so it '.as necessary to purchase the land and assess <br /> everyone. In his opinion, if it .4as necessary to include land acquisition <br /> then everyone should be treated the same. <br /> <br /> There being no further testimony, Mayor Mercer declard the public hearing <br /> closed on this item. <br /> <br /> Mr. Brunsell advised that the letter from Kaiser Foundation Health should <br /> be considered a written protest and entered into the record. <br /> <br /> Mr. Walker stated that no other written protests had been received. <br /> <br /> Council discussion ensued regarding the request by Kaiser Foundation <br /> Health for exemption from the Assessment District. <br /> <br /> It was moved by Councilmember Mohr that Kaiser Foundation Health be re- <br /> duced to 0 assessment on the roadway improvements for the North Pleasanton <br /> Improvement District. <br /> <br /> The motion died for lack of a second. <br /> <br /> It was nloved by Councilmember Brandes, and seconded by Councilmember Wood, <br /> to deny the request for exemption from the North Pleasanton Improvement Dis- <br /> trict and overrule the protest of Kaiser Foundation Health. <br /> The roll call vote was as follows: <br /> <br /> 7-16-85 <br /> -9- <br /> <br /> <br />
