387 <br /> per square foot of building space, for any buildings for which Duilding <br /> mits have been issued within one year of the adoption of the fee and for all <br /> Duildings constructed thereafter until revocation of the fee. <br /> <br /> After discussion regarding the estimated amount of the school mitigation <br /> fee which has not Deen established at this time, Mayor Brandes withdrew his <br /> motion. <br /> <br /> Mr. Pogue stated he would agree to a condition relative to school mitiga- <br />tion'fees but would not like to leave the amount open. He felt the school <br />mitigation fees should be applied fairly between residential and industrial <br />development. <br /> <br /> Councilmember Wood seconded the motion made by Councilmember Mercer that a <br />condition be added to require the development to agree to a school mitigation <br />fee not to exceed 25 cents per square foot, if it is enacted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, and Wood <br />NOES: Councilmember Butler and Mayor Brandes <br />ABSENT: None <br /> <br /> Mayor Brandes requested that Koll Company be required to enter into a <br />development agreement with the City. Council concurred. Mayor Brandes in- <br />structed the City Attorney to meet with the Koll Company to work out details <br />of the development agreement. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Ordinance No. 1257, to be read by title only and waiving further reading <br />thereof, approving PUD-80-2-2M, application of Bernal Avenue Associates and <br />the Koll Company for a major modification to an approved rezoning and develop- <br />ment plan for a business park, including changes to development standards, <br />landscaping, and design guidelines to be located on an approximately 99 acre <br />site, located generally in the area bounded by Bernal Avenue, Interstate 580, <br />the Arroyo del Valle, and Valley Avenue, subject to all conditions contained <br />in Staff Report 86:226 and conditions added by Council as shown above, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> Mayor Brandes declared the public hearing open on PUD-80-2-1D for design <br />review approval of eight one story and one three story office buildings. <br /> <br /> Mr. Terry Jacobson, Leason & Pomeroy Associates, gave a slide presentation <br />on the design and location of the proposed buildings. He presented buildings <br />materials that will be used for construction. <br /> <br /> No one in the audience spoke in opposition to this application. <br /> <br /> Mayor Brandes declared the public hearing closed. <br /> <br /> Councilmember Mercer expressed concern regarding the three story office <br />building being too close to Valley Avenue; he felt the building should be low- <br />er or moved to the center of the property. <br /> <br /> - 7 - 6-3-86 <br /> <br /> <br />
