261 Mr. Swift presented his report (SR 87:299) dated July 7, 1987, regarding this matter. Mayor Mercer declared the continued public hearing Open on the item. Mr. Ralph Romero, 2810 Foothill Road, stated the application is consistent with the balance of lots in Foxborough. He advised that Council has already approved a modification from 39 lots to 48 lots, and as of today 23 lots have closed escrow. He stated that all 23 owners have been contacted and are in favor of his application. He advised the remaining 25 lots are owned by HSC, who support the application. He stated he agrees with the conditions set forth in the staff report. No one in the audience spoke in opposition to the appeal or application. There being no further testimony, Mayor Mercer declared the public hearing closed on this item. Councilmember Butler stated that although this application meets the in- tent of the zoning ordinance and there is no conflict, it is not Council's normal procedure the change PUD approvals.
