WHEREAS, the real property ("Phase II Property"), <br />located within the City of Pleasanton, County of Alameda, <br />State of California, and located within the area known as <br />Phase II of the Hacienda Business Park, and further de- <br />scribed in Exhibit A attached hereto and incorporated by <br />this reference, is subject to the terms of the Development <br />Agreement ("Phase II Development Agreement"), dated as of <br />April 22, 1986 and recorded May 1, 1986, as Instrument <br />No. 86-103893, relating to Parcel Map 3863, Official Records <br />of Alameda County, California; <br /> <br /> WHEREAS, California Government Code Section 65865.1 <br />requires annual review by City of compliance with the <br />Phase I Development Agreement and the Phase II Development <br />Agreement (collectively, "Development Agreements"), in <br />accordance with the procedures established by City; and <br /> <br /> WHEREAS, City has received substantial factual <br />evidence of good faith compliance with the terms of the <br />Development Agreements, in accordance with the procedures <br />established by City; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON HEREBY DOES FIND AND DETERMINE AS FOLLOWS: <br /> <br /> Section 1. Findings. <br /> <br /> (a) The actions, programs of public works <br />construction, economic investments, policies, and technical <br />and legal analyses undertaken in fulfillment of the Develop- <br />ment Agreements are hereby found to comply with the terms of <br />the Phase I Development Agreement in that they satisfy each <br />of the general objectives and specific requirements set <br />forth in the Phase I Development Agreement that applied to <br />Phase I during the interval commencing March 1, 1987 and <br />ending February 29, 1988. <br /> <br /> (b) The actions, programs of public works <br />construction, economic investments, policies, and technical <br />and legal analyses undertaken in fulfillment of the Develop- <br />ment Agreements are hereby found to comply with the terms of <br />the Phase II Development Agreement in that they satisfy each <br />of the general objectives and specific requirements set <br />forth in the Phase II Development Agreement that applied to <br />Phase II during the interval commencing March 1, 1987 and <br />ending February 29, 1988. <br /> <br /> Section 2.
