He advised that the car wash would be closed from 10:00 <br /> p.m. to 6:00 a.m., and that the lighting has been cut down. He asked for ap- <br /> proval based on his record. <br /> <br /> Mr. Levine requested that Condition No. 13 - That there shall be no truck <br /> deliveries, parking lot sweeping or garbage pick-up between the hours of 10:00 <br /> p.m. and 6:00 a.m., be amended to allow fuel delivery trucks to unload gas <br /> between those hours to avoid conflict with other vehicles. He also asked that <br /> Condition No. 11 That at no time shall the sale of any alcoholic beverage be <br /> permitted at the food mart facility, be deleted. <br /> <br /> The following persons spoke in opposition to the application: <br /> <br /> Mr. Robert Fairman, 3979 Fairlands Drive, stated he has a two story home <br /> behind the proposed development and he strongly opposed the application. He <br /> advised he looked into the permitted uses in this area before he purchased his <br /> home and he did not expect that fast foods or mini-marts would be allowed. He <br /> stated these will have an adverse effect on the neighborhood. He thought it <br /> incredible that the Planning Commission would allow sale of beer and wine so <br /> near Santa Rita jail. He stated the site of the Hopyard Shell Station is com- <br />CD pletely different than the proposed location; it is not near residential. He <br />(.C) expressed concern regarding a potential traffic problem at this intersection. <br />~_~ He disagreed with the environmental assessment regarding noise impacts and <br /> environmental impacts, which were noted as insignificant in the report. He <br /> '~ concluded by stating the proposed project will be a nuisance to many residents <br /> in the area. <br /> <br /> Mr. Mike Fitzsimmons, 3655 Camelot Court, stated he owns a two-story home <br /> that faces the proposed project. He felt there is confusion over the designa- <br /> tion of a convenience store; to fill a market need for convenience and hours <br /> of operation. He stated that with the Long's Drug Store in this area there is <br /> no need for another mart to sell alcohol. He asked that Council preserve the <br /> quality of life in Pleasanton Meadows; 24 hour operation of a service station <br /> is ludicrous. He stated there will be increase in noise, traffic problems at <br /> that intersection and increased traffic on Fairlands Drive. He questioned the <br /> setback of 10 feet behind residences; he felt this was too close. He stated <br /> as a resident he is violently opposed to the 24 hour operation and is con- <br /> cerned about releasees from the prison being a problem. He added that Mr. Cox <br /> runs an outstanding station on Hopyard Road but that site is a different <br /> situation. <br /> <br /> Mr. Dave Baxley, 3911 Fairlands Drive, stated that Long's Drug Store is <br /> not visible from his area, while the service station will be in full view. He <br /> felt the hours of operations should be much less than 24 hours per day. He <br /> stated the station can be seen from the freeway, which will increase the prob- <br /> lem with trucks in the area. He expressed concern regarding the station's <br /> proximity to the jail, the buffer zone not being adequate, and visibility of <br /> the proposed project. <br /> <br /> Mr. Henry Hatton, 3963 Fairlands Drive, stated he has lived at this <br /> residence since 1971, and that Pleasanton Meadows is a nice neighborhood; like <br /> the residents from Happy Valley he wants to preserve the quiet residential <br /> character of his neighborhood. <br /> <br /> 12 - 12-15-87 <br /> <br /> <br />
