377 <br /> the Black's would work with staff regarding the fire turn-around and the <br /> grading. <br /> <br /> Mr. Don Babbitt, Architect, presented four plans in overlay fashion to <br /> show the changes made since the original plan was approved. <br /> <br /> Mayor Mercer expressed confusion as to which plan had been approved by <br /> Council and which plans had been reviewed by the Planning Commission. Ms. <br /> Lewman, Attorney representing the Blacks, stated that Council approved the <br /> original Plan A proposal; the plan as proposd tonight has two changes - the <br /> hammerhead and the grading; the location is the same. Planning Commission has <br />.... not reviewed this plan. <br /> <br /> Mr. Fraser presented the proposed landscaping plans; which he felt would <br /> appropriate screen the house. <br /> <br /> Mr. Jim Balch, 14 Grey Eagle Court, stated he relied heavily on the staff <br /> reports when he bought his property; the area where the Black's propose to <br /> build their home was to be an open field. He felt he had made a lot of con- <br /> cessions to accommodate the Blacks. He stated he raised several questions at <br /> the last homeowners meeting which he did not receive a satisfactory answer <br /> relative to the height and the building pad. He stated the movement of the <br /> building as proposed will move it 30-40 feet to the east and raised up 8 feet, <br /> which has not been addressed by staff. He stated the PUD was originally ap- <br /> proved with the building pad down low the Blacks want to raise the building <br /> pad and but the hill so they will have a view; he felt this is a violation to <br /> his rights. <br /> <br /> Mr. Bob Grove, 28 Grey Eagle Court, stated he attended the homeowners <br /> meeting and also participated in the vote by mail. After receiving a letter <br /> addressed to him by the attornies for the Black's he felt he had an obligation <br /> to address what he felt is blatent misinformation in the letter. He stated <br /> Council looked to the homeowners association to determine whether or not the <br /> objections raised as to the location of this house were significant. He ad- <br /> vised that out of 22 lots 2/3 did not approve Plan 3. He questioned the <br /> legality of counting the five written votes received after the homeowners <br /> meeting. He stated that Mr. O'Callaghan and Mr. Harris have tried to get an <br /> accurate concenses of the homeowners; they felt there is not overwhelming sup- <br /> port for the proposed plan they are in favor of the plan as originally <br /> approved. <br /> <br /> Mr. Paul Molkenbuhr, 15 Grey Eagle Court, stated the Black's and their <br /> representatives met with the homeowners at an association meeting, a vote was <br /> taken, and he did not feel a revote would be appropriate. He added that it <br /> was not determined whether the written votes should be taken before or after <br /> the meeting. <br /> <br /> Ms. Randie Black, 3742 Pinot Court, stated she had tried in every way to <br /> adjust and readjust her house plans to meet all restraints. She stated they <br /> want to move the house up to provide a view out the back and they will put in <br /> trees to block the house from the view of the neighbors. She stated the grad- <br /> ing is not a problem with the fire department. She appealed to Council to <br /> consider her need to construct her home to best suit her needs. <br /> <br /> Mr. Mike Isabel, 9 Roman Eagle Court, stated he does not feel it is legal <br /> to take a revote regarding this matter. <br /> <br /> - 10 - 10-20-87 <br /> <br /> <br />
