3 <br /> <br />1. The owners of Pastime Pool, through Jay Nelson, violated Sec- <br /> tion 6.12.080 P.M.C. (hours of operation) by permitting <br /> operation of the cardroom after 2:00 a.m. on the morning of <br /> December 29, 1987. <br /> <br />2. The owners of Pastime Pool, through Jay Nelson, violated Sec- <br /> tion 6.12.140 P.M.C. (permitted card games) by allowing play- <br /> ing of a game prohibited by that section. <br /> <br />3. The owners of Pastime Pool, through Jay Nelson, violated Sec- <br /> tion 6.12.150 P.M.C. (state law violations). <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes to suspend the cardroom <br />license of the Pastime Pool for ninety (90) days. <br /> <br /> The motion died for lack of a second. <br /> <br /> After further discussion, it was moved by Councilmember But- <br />ler, and seconded by Councilmember Mohr, that Resolution No. 88- <br />39, based upon the findings of fact and conclusion of law made by <br />the City Council, the following discipline is imposed upon the <br />licensee Pastime Pool and its owners, Jay Nelson and Frank <br />Shenave: <br /> <br /> Suspension of License of cardroom for thirty (30) days <br /> commencing with December 29, 1987, and concluding <br /> January 27, 1988 <br /> <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the City Council Calendar for the infor- <br />mation of the Council. <br /> <br />EXECUTIVE SESSION <br /> No Executive Session was held this date. <br /> <br />ADJOURNMENT <br /> There being no further business at 12:30 a.m., it was moved <br />by Councilmember Wilson, and seconded by Councilmember Mohr, that <br />the meeting be adjourned to meet again in Regular Session on <br /> <br /> - 18 - 1-19-88 <br /> <br /> <br />
