3 1. The owners of Pastime Pool, through Jay Nelson, violated Sec- tion 6.12.080 P.M.C. (hours of operation) by permitting operation of the cardroom after 2:00 a.m. on the morning of December 29, 1987. 2. The owners of Pastime Pool, through Jay Nelson, violated Sec- tion 6.12.140 P.M.C. (permitted card games) by allowing play- ing of a game prohibited by that section. 3. The owners of Pastime Pool, through Jay Nelson, violated Sec- tion 6.12.150 P.M.C. (state law violations). The roll call vote was as follows: AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer NOES: None ABSENT: None It was moved by Councilmember Brandes to suspend the cardroom license of the Pastime Pool for ninety (90) days. The motion died for lack of a second. After further discussion, it was moved by Councilmember But- ler, and seconded by Councilmember Mohr, that Resolution No. 88- 39, based upon the findings of fact and conclusion of law made by the City Council, the following discipline is imposed upon the licensee Pastime Pool and its owners, Jay Nelson and Frank Shenave: Suspension of License of cardroom for thirty (30) days commencing with December 29, 1987, and concluding January 27, 1988 be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer NOES: None ABSENT: None COMMUNICATIONS There were no Communications presented at this meeting. CITY COUNCIL CALENDAR Mr. Walker presented the City Council Calendar for the infor- mation of the Council. EXECUTIVE SESSION No Executive Session was held this date. ADJOURNMENT There being no further business at 12:30 a.m., it was moved by Councilmember Wilson, and seconded by Councilmember Mohr, that the meeting be adjourned to meet again in Regular Session on - 18 - 1-19-88
