NOES: None <br /> ABSENT: Councilmember Butler <br /> <br /> Council discussion ensued regarding whether or not Council <br /> shall prepare a direct argument, either for or against, the <br /> initiative measure. Mr. Beougher advised that the proponents of <br /> the initiative would have to waive their right for arguments if <br /> Council decided to prepare an argument. <br /> <br /> Mr. Cox stated he would not like to waive his right to <br />prepare the the argument in favor of the initiative; he would like <br />to retain the right to do that himself. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, that Resolution No. 88-379, determining that <br />the City Council shall not prepare a direct argument, either for <br />or against, the initiative measure thus allowing the proponents <br />and opponents the right to make a statement on the ballot, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, to allow rebuttal arguments to be submitted <br />in response to direct arguments pertaining to the initiative <br />measure, subject to determining the priority of those authorized <br />to sign the arguments and rebuttals. <br /> <br /> Council discussion ensued regarding who is authorized to <br />sign the arguments and who is authorized to sign the rebuttals. <br /> <br /> After further discussion, Councilmember Brandes withdrew his <br />motion and Councilmember Wilson withdrew his second. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Mohr, that Resolution No. 88-380, allowing rebuttal <br />arguments to be submitted in response to direct arguments <br />pertaining to the initiative measure in accordance with the <br />procedures as set forth in Sections 4015.5 and 5014.5 of the State <br />Elections Code, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Mercer <br />NOES: Councilmember Wilson <br />ABSENT: Councilmember Butler <br /> <br />REPORTS OF THE CITY ATTORNEY <br /> There were no reports of the City Attorney presented at this <br />meeting. <br /> <br /> -9- <br /> <br /> 8-2-88 <br /> <br /> <br />
