403 <br /> <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />item 12q <br />Modification to Grading Ordinance <br /> Mr. Swift presented his report {SR 88:264) dated June 7, 1988, regarding <br />this matter, to clarify that approval of grading permits is a discretionary <br />function of the building official and that development project grading conform <br />to an approved grading plan. <br /> <br /> Mr. Darryl Alexander, Alexander & Associates, stated he has a concern <br />about the word "discretionary" approval, in Section'7OO6(g). He questioned <br />the use of a building officiai's discretion. Mr. MacDonald explained that a <br />"discretionary" cannot be an "arbitrary" decision and must have a rational <br />5asis, however, a "discretionary"_decision gives more leeway for the public <br />official to exercise his other judgment than a "ministered" decision in which <br />the public official must issue the permit if certain objective criteria are <br />met. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Ordinance No. 1364, to be read by title only and waving further reading <br />thereof, amending Chapter 20.08 {Building Code) relating to procedures for <br />issuance of grading permits, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />REPORTS OF THE CITY ATTORNEY <br />item 13a <br />Consider Introduction of Ordinance Reinstating Exemption for Low and Moderate <br />Income Housing to the Growth Management Program <br /> Mayor Mercer declared this item removed from the agenda, at the request of <br />staff. <br /> <br />item 13b <br />Consider Introduction of Ordinance Modifying Growth Manaqement Proqram to Per- <br />mit School District to Obtain Growth Manaqement Approval of Lands without PUD <br />Approval <br /> Mayor Mercer declared this item removed from the agenda, at the request of <br />staff. <br /> <br />item 13c <br />Notice of Intent to Adopt a Resolution of Necessity Regarding Condemnation of <br />Molinaro Property <br /> Mr. MacDonald presented his report {SR 88:237) dated June 7, 1988, regard- <br />ing this matter. He stated that Council direction is also requested concern- <br />ing action to be taken on a 1.2 acre parcel owned by Mr. Molinaro needed for <br />Nielsen Park. <br /> <br /> Mr. Molinaro, P. O.
