439 <br /> <br /> Mr. Swift presented his reports (SR 88:558, SR 88:563, and SR <br />88:564) dated December 6, 1988, regarding these three items. <br /> <br /> Vice Mayor Butler declared the continued public hearings <br />open. <br /> <br /> Mr. Joseph E. Madden, 1544 Santa Rita Road, stated he is <br />offering his comments as an individual and does not represent <br />anybody else or any organization. The Triangle Junction <br />Development Plan approval request involves three parcels of land; <br />two ten acre parcels with which he is involved and a one acre <br />parcel that he is not involved with. He presented a brief <br />historical summary of the two parcels he is involved with. He <br />owned a 7.65 acre parcel and a 6.0 acre parcel totaling 13.65 <br />acres of land between the SP and WP railroad tracks. This land <br />had a very limited access where Stanley Boulevard makes a right <br />angle turn towards Main Street. In March 1982 Council approved <br />the rezoning of these 13.65 acres to PUD-Commercial with a list of <br />permitted and conditional uses and the condition that these 13.65 <br />acres gain ingress and egress to Stanley Boulevard going towards <br />Livermore. About four years ago the two existing ten acre parcels <br />were generated by the processing of two parcel maps. About two <br />years ago Council approved the same Commercial PUD zoning and same <br />lists of permitted and conditional uses on the land that was <br />formerly the SP right of way. Mr. Madden stated it is his opinion <br />the only issue on the two ten acre parcels is the merits of <br />allowing the listed conditional use of a supermarket at this <br />proposed site at this time under the applicant's development plan <br />and corresponding off-site impacts. <br /> <br /> Mr. Earl Augusta, 713 Camelia Court, Ripon, stated he is <br />concerned about what will happen to his property if the proposed <br />project is disallowed. He stated that at the time the property <br />was changed to Commercial, he requested that his parcel be changed <br />to residential to retain the rural atmosphere, and the rezoning <br />was approved. He stated at that time he did not know his property <br />would be surrounded by condominiums; the rural atmosphere has <br />changed drastically. He advised that if the Del Valle Parkway <br />goes through and as the City grows, traffic will become heavier <br />and heavier. He stated that commercial will be adjacent to his <br />property and he cannot maintain the rural residential atmosphere, <br />so it no longer makes sense to maintain a residence on this <br />parcel. He felt the General Plan amendment should be approved <br />whether or not the project is approved. Mr. Augusta feels the <br />Triangle Junction project is an excellent one; Stanley Boulevard <br />is the eastern entrance to the City and this project would enhance <br />the entrance. He stated the staff report recommends service <br />commercial; he felt this would be a bad choice and cause Mr. <br />Madden to have to sell his property piece by piece. He felt the <br />property should be sold at one time and developed at one time. He <br />stated the proposed project would help fund the lighting on <br />Stanley and help with traffic control improvements.
