Zoning for the property is PUD (Planned <br />Unit Development)-Hiqh Density Residential District , <br /> Mr. Swift presented his report (SR 88:434) dated September 6, <br />1988 regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the item. <br /> <br /> Mr. Duncan Matteson, applicant with JL Construction Company, <br />stated he concurs with the staff report with one exception: he <br />would like to have the condition deleted relating to the <br />requirement that one-bedroom units within the project shall be <br />offered for sale within the range $90,000-$97,000, and that two <br />bedroom units be within the range $130,000-$139,000, allowing for <br />adjustments attributable ~o increases in construction costs. He <br />did not want a price range placed on the units. <br /> <br /> No one spoke in opposition to this matter. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> Mayor Mercer stated that Mr. Matteson and his partner have <br />built two other projects in the community and have done what they <br />said they would do in trying to bring in affordable units. He <br />stated he has a philosophical problem in saying Council should <br />put a limit on what a developer can sell his property for. <br /> <br /> Councilmember Butler agreed; Council has not made prices a <br />condition on other projects and he saw no reason why this <br />development should not be treated as a free market project. <br /> <br /> Councilmember Mohr stated this project is a little in the <br />gray area in the concept of affordable housing, but she felt this <br />condition is not necessary. <br /> <br /> Councilmember Brandes stated he will oppose the project; he <br />feels it is inappropriate and premature. He did share the <br />comments regarding Mr. Matteson and Mr. Ferreri's previous <br />projects. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Ordinance No. 1382, to be read by title <br />only and waiving further reading thereof, approval of PUD-87-4-2M, <br />application of JL Construction Company and Duncan Matteson for a <br />major modification to an approved development plan for a 244-unit <br />residential complex to modify the mix of the unit composition and <br />to modify the private recreation area facilities to be located on <br />an approximately 23 acre site located at 11020 Old Dublin Canyon <br />Road, subject to conditions set forth in Staff Report 88:434, but <br />deleting the Planning Commission condition which required set <br />prices on units but allowing for adjustments attributable to <br /> <br /> - 10 - <br /> <br /> 9-6-88 <br /> <br /> <br />
