CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-101 <br /> <br /> RESOLUTION ACCEPTING GRANT DEED FOR STREET DEDICATION <br /> AND VACATING A RIGHT-OF-WAY ON SUNOL BOULEVARD <br /> <br />WHEREAS, at its meeting of March 15, 1988, Council reviewed the <br /> staff report (SR 88:93) recommending the vacation of a <br /> portion of the public right-of-way along Sunol <br /> Boulevard, more particularly described on Exhibit "A" <br /> attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, the excess right-of-way is not required for street or <br /> pedestrian purposes; and <br /> <br />WHEREAS, the City is in receipt of a deed from Sunol Office <br /> Park-B to the City of Pleasanton, for purposes of a <br /> right turn pocket at Sunol Boulevard and Junipero <br /> Street; and <br /> <br />WHEREAS, the above referenced staff report indicates that the <br /> acceptance of this deed is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Grant Deed from Sunol Office Park-B to the City <br /> of Pleasanton is hereby accepted and the appropriate <br /> City officers are instructed to take whatever action <br /> necessary to implement said acceptance. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and HIghways <br /> Code and based upon the findings above establishing that <br /> the right-of-way is not required for street or <br /> pedestrian purposes pursuant to Section 8334 of the <br /> Streets and Highways Code, the public right-of-way <br /> described in Exhibit "A" is hereby vacated, reserving <br /> easements for storm drainage over a portion of the area <br /> to be vacated. <br /> <br />Section 3: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office of <br /> the Alameda County Recorder. <br /> <br />Section 4: That from and after the date the resolution is <br /> recorded, the street, highway, or public service <br /> easement vacated no longer constitutes a street, <br /> highway, or public service easement. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
