Items 1, 7, and 8 were <br />waiting for further instructions from the City. <br /> <br /> Councilmember Brandes asked if Mr. Beratlis was willing to <br />stipulate that the project can be complete within sixty days. Mr. <br />Beratlis confirmed that could be done. He also indicated the <br />soundwall on Crellin Road would start construction tomorrow. <br /> <br /> Mike Clayburn, builder at 942 Finovino, was in favor of <br />occupancy as soon as possible. <br /> <br /> Jim Happ, builder of four homes, needs to deliver two of them <br />within three weeks, and he urged early occupancy. <br /> <br /> Mr. Brandes indicated this is the first time Pleasanton has <br />dealt with a subdivision of independent builders and Council wants <br />to be sure everything is done properly. <br /> <br /> Councilmember Tarver said that if residents had appeared and <br />objected to changing the conditions, he would have opposed this <br />modification; but since no one objected, he will be in favor of <br />it. <br /> <br /> It was moved by Councilmember Mohr, and seconded by <br />Councilmember Brandes, to adopt Resolution No. 89-288, to approve <br />a modification to conditions of approval to Tract 5835 to allow <br />occupancy prior to final acceptance of Tract improvements, <br />subject to staff recommendations. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Tarver, and Brandes <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Councilmember Butler and Mayor Mercer <br /> <br />13. REPORTS OF THE CITY ATTORNEY <br /> There were no reports from the City Attorney. <br /> <br />14. COMMUNICATIONS <br /> There were no communications presented at this meeting. <br /> <br />15. CITY COUNCIL CALENDAR <br /> Mr. Walker presented the City Council Calendar for the <br />information of the Council. <br /> <br />16. CLOSED SESSION <br /> Council adjourned to a closed session at 11:45 p.m. to <br />discuss real property negotiations. <br /> <br />17. ADJOURNMENT <br /> There being no further business at 12:15 a.m., it was moved <br />by Councilmember Mohr, and seconded by Councilmember Butler, that <br /> <br /> -19- <br /> <br /> 6-20-89 <br /> <br /> <br />
