161

Ms. Elaine Buckland, 4132 Suffolk Way, pointed out a comment
made by Mr. Simmons at one of the Planning Commission meetings
that there were so many conditions imposed in the CC&Rs that they
could not possibly be expected to meet all of them. She stated
that Gatewood should not now be allowed what they were disallowed
then. In this regard, she brought up the car wash decision made
then that residents could use commercial facilities the same way
non-residents do. She then handed the Councilmembers a letter
containing some points for further consideration.

Mr. Ruth clarified that the tot lot is not a big playground
with massive equipment. It is a small space that was put in
because there was no other facility in the area for children to
play on. Regarding the carwash, he understood that no permission
was required to have a carwash area.

Mr. Joe Simmons, Property Developer of Gatewood Apartments,
explained their proposal to remove the RV parking area from the
corner and put them along the solid fences on the east and west
sides of the property; that way they would not be visible from the
outside and do away with the objections of unsightliness and its
becoming a congregating place for parties and possible drug-
dealing. The carwash, a single spigot and a hose, would be
removed from the back corner and put along the west fence line.

Mr. Edward Bruhn, 4050 Suffolk Way, stated that the carwash
and tot lot would be good for the residents. However, the CC&R
has established that no RVs and boats would be allowed. He then
asked if a tenant who had one covered and one open parking space
in the complex would be allowed to park his RV or boat in one of
these spaces.

Mr. Mercer answered that if the Council did not allow RV
parking, then the tenant would not be able to park them, whether
in the covered or open space. He reiterated that the question is
if they would be allowed to move the tot lot, have more than one
carwash, and park RVs and boats on the site.

Mr. Brandes indicated that if the City allowed the relocation
of the RV parking, he would have no objection. However, he
expressed the concern that if other subdivisions are not allowed
to park their RVs on site, allowing it at any location at Gatewood
could start a precedent.

Mr. Lou Baldacci, Far West Associates, stated that they have
a project right next to Gatewood and the proposed carwash.sites
would back up to some of the backyards of their future residents.
He requested that should the Council allow for additional carwash
sites, these be put in a location other than next to their
backyards.

-8-
