383

contamination was found. Other enforcement and regulatory
agencies were contacted, which in turn notified Gatewood
management that the Hazardous Waste Control Act had been violated
and that the pond had to be cleaned out.

The pond has been cleaned out; a separation tank has been
placed on the site into which the pond's contents were dumped,
discharged and separated. Samples were taken for analysis to
determine how much of this can be discharged into the sanitary
sewer system, which is legal, and how much of what remains has a
high copper content, which must be hauled away to the hazardous
material dump site. Large cracks were also discovered on the base
of the pond. An investigation will be conducted to see if the
ground has been contaminated and to determine a future course of
action. Gatewood management has posted a sign by the pond warning
people to stay out.

Mr. Mercer inquired if fines and penalties were levied
against Gatewood.

Mr. Hill replied that the case is in the hands of the
District Attorney's Office.

Mr. Tarver asked if Gatewood management was required to
report the use of hazardous materials to the Fire Department.

Mr. Hill answered that businesses are required to report such
cases; Gatewood is considered a residential use.

Mr. Mercer inquired if there were other places in the City
that use this kind of materials.

Mr. Hill said yes.

Mr. Brandes commented that it might be worthwhile to inspect
other complexes with swimming pools.

Item 8d
Park and Recreation Commission Appointment

Mr. Mercer opened the discussion on his proposed appointment
to the Parks and Recreation Commission.

It was moved by Ms. Mohr, and seconded by Mr. Tarver, that
Resolution No. 89-423 be approved, appointing Mr. Robert Silva as
a Regular Member of the Parks and Recreation Commission and
appointing Ms. Trish Maas as an Alternate Member, both terms to
expire February 15, 1991.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

-8-
10-3-89
