Other enforcement and regulatory <br />agencies were contacted, which in turn notified Gatewood <br />management that the Hazardous Waste Control Act had been violated <br />and that the pond had to be cleaned out. <br /> <br /> The pond has been cleaned out; a separation tank has been <br />placed on the site into which the pond's contents were dumped, <br />discharged and separated. Samples were taken for analysis to <br />determine how much of this can be discharged into the sanitary <br />sewer system, which is legal, and how much of what remains has a <br />high copper content, which must be hauled away to the hazardous <br />material dump site. Large cracks were also discovered on the base <br />of the pond. An investigation will be conducted to see if the <br />ground has been contaminated and to determine a future course of <br />action. Gatewood management has posted a sign by the pond warning <br />people to stay out. <br /> <br /> Mr. Mercer inquired if fines and penalties were levied <br />against Gatewood. <br /> <br /> Mr. Hill replied that the case is in the hands of the <br />District Attorney's Office. <br /> <br /> Mr. Tarver asked if Gatewood management was required to <br />report the use of hazardous materials to the Fire Department. <br /> <br /> Mr. Hill answered that businesses are required to report such <br />cases; Gatewood is considered a residential use. <br /> <br /> Mr. Mercer inquired if there were other places in the City <br />that use this kind of materials. <br /> <br /> Mr. Hill said yes. <br /> <br /> Mr. Brandes commented that it might be worthwhile to inspect <br />other complexes with swimming pools. <br /> <br />Item 8d <br />Park and Recreation Commission Appointment <br /> <br /> Mr. Mercer opened the discussion on his proposed appointment <br />to the Parks and Recreation Commission. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that <br />Resolution No. 89-423 be approved, appointing Mr. Robert Silva as <br />a Regular Member of the Parks and Recreation Commission and <br />appointing Ms. Trish Maas as an Alternate Member, both terms to <br />expire February 15, 1991. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> -8- <br /> 10-3-89 <br /> <br /> <br />
