117

It was moved by Mr. Brandes, and seconded by Mr. Butler, that
Resolution No. 90-68 be adopted, based on a review of an initial
environmental impact study done for this project and on a finding
that no significant environmental impact would occur as outlined
in the City's guidelines and on a further finding that a negative
declaration is appropriate in connection with AP-90-02, (PUD-89-
22), Bren Company, the appeal of the Planning Commission decision
denying Case PUD-89-22, the application of Bren Company for
planned unit development rezoning and development plan approval to
construct a ll2-unit single-family residential complex to be
located on an approximately 13.7 acre site located at the
northeast corner of the intersection of Santa Rita Road and
Stoneridge Drive.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Mr. Brandes indicated that he would support this project
because it addresses the concerns of the neighbors on both sides
of the Arroyo and would be in sharp contrast to the apartment
houses close by. It is also important to have this type of
project on the property at this time. He commented that he would
like to see the conditions of approval for the project which were
not included in the staff report.

Mr. Tarver suggested that the application could be brought
back to Council with the conditions of approval, and growth
management could be extended, if necessary.

Mr. Mercer asked Mr. Swift if he had a copy of the conditions
of approval.

Mr. Swift replied that if Council wishes to approve the
project, the ordinance could be initiated and staff will bring
back the conditions of approval at the next meeting when the
ordinance is presented for adoption.

Mr. Roush agreed that this could be done.

Mr. Mercer indicated that he would like to include in the
conditions of approval the same condition put on the two major
projects on Foothill Road that the developers meet with the School
District to mitigate the impacts of the development on schools,
prior to the issuance of building permits and occupancy of the
units.

- 9 -
3-20-90
