152 <br /> <br /> Mr. Roush stated that rezoning could be considered <br /> separately. <br /> <br /> Mr. Swift indicated that either one would work. If Council <br /> decides to rezone, however, action would have to be taken on <br /> either a straight Negative Declaration without conditions, or a <br /> mitigated Negative Declaration, as recommended by staff. <br /> <br /> Mr. Beratlis stated that he originally tried working with a <br /> PUD, but the Low Density would not allow him to come up with the <br /> 15 lots he wanted. <br /> <br /> Mr. Butler indicated that he would prefer just to adopt a <br /> resolution of intention for the PUD rezoning now and have the <br /> Negative Declaration come back as part of the PUD, because this <br /> development involves issues which impact the environment. The <br /> number of lots in the development can then be considered and <br /> resolved. <br /> <br /> Mr. Mercer agreed with Mr. Butler. He stated that if the <br /> developer came back with one cohesive package, questions could be <br /> answered on the Negative Declaration as well as on the rezoning <br /> and other project issues. Council can then decide on those issues <br /> which the meeting between the developer and the neighbors did not <br /> resolve. <br /> <br /> Mr. Beratlis inquired if the process would start with the <br /> City Council or go back to the Design Review Board. <br /> <br /> Mr. Mercer replied that he would have to bring back the <br /> revised plan, resulting from the neighborhood meetings, to the <br /> Design Review Board, the Planning Commission and the Council. <br /> <br /> It was moved by Mr. Butler, and seconded by Mr. Brandes, that <br /> Resolution No. 90-49 be adopted, a resolution of intention to <br /> initiate a rezoning for an approximately 10 acre site located at <br /> 10 Beratlis Place from the "A" (Agricultural) District to the PUD <br /> - Low Density Residential, subject to the condition that the <br /> developer meet with the neighbors to address landscaping on the <br /> slopes and other environmental concerns related to the grading and <br /> siting of the houses on the lots and the final plan brought back <br /> to Council for action. <br /> The roll call vote was as follQW~: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Mr. Mercer stated that meetings between Mr. Beratlis and the <br /> neighbors would be set up, which meetings he and Mr. Tarver would <br /> attend.
