ADDliCatiOn tO Rezone an Approximately <br /> 10 Acre Site Locate4 at 10 Beratlis Place from the mAm <br /> /AariC~ltural~ District to the R-1-20.000 [Sinale-Familv <br /> Residential) Distr~ct or Any other zonina District Consistent with <br /> the General Plan <br /> <br /> Consider Adoption of a Neaative Declaration <br /> <br /> Mr. Swift presented his report (SR 90:97) regarding the <br /> matter. <br /> <br /> Mr. Butler requested Mr. Roush to summarize the position of <br /> the Amador Valley Savings and Loan stockholders with regard <br /> this project. <br /> <br /> Mr. Roush explained that the issue appears to be whether or <br /> not there is a conflict of interest for the Councilmembers owning <br /> stock with Amador Valley Savings and Loan. Because of the <br /> location of this property and the fact that the interest is only <br /> an investment-type interest, stockholders can participate in the <br /> decision. <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Mr. Chris Beratlis, 425 Main Street, stated that he concurred <br /> with the recommendations of the Staff Report and the Planning <br /> Commission with the exception of two issues: (1) installing the <br /> landscaping prior to the issuance of building permits~ and (2) <br /> limiting the houses on some lots to one story. He explained that <br /> prior to the issuance of building permits, there would be no water <br /> to irrigate the landscaping. His plan is to do the landscaping <br /> simultaneous with the issuance of the building permits. He then <br /> requested that he be given the option of building two-story units <br /> if necessary. <br /> <br /> Mr. Brandes asked Mr. Beratlis how the landscaping would be <br /> maintained and if he were amenable to any conditions staff would <br /> put up for the maintenance of the landscaping once it is <br /> installed. <br /> <br /> Mr. Beratlis replied that the CC&Rs for the lots concerned <br /> would include the responsibility for landscaping maintenance and <br /> that he is amenable to any mechanism the City would employ to <br /> ensure that. <br /> <br /> Ms. Becky Dennis, 838 Gray Fox Circle, whose property abuts <br /> the proposed development and representing the neighbors at 814 and <br /> 850 Gray Fox Circle, presented a letter with the following <br /> suggestions to implement as conditions to the rezoning: (1) The <br /> square footage on the slope banks adjacent to Lots i and 4 of <br /> Foxborough and Lots 33 and 31 of Vintage Heights II may not be <br /> <br /> - 10 - <br /> 3-6-90 <br /> <br /> <br />
