6] <br /> <br /> Mr. Mercer indicated that he concurred with the report. <br /> <br /> Mr. Brandes stated that he was not in favor of a lease <br />agreement. <br /> <br /> Mr. Tarver commented some consideration should be offered for <br />the use of public property by the restaurant. <br /> <br /> Mr. Roush stated that staff would come up with a fair market <br />value for the property, so the lease would not be for a nominal <br />sux~. <br /> <br /> Mr. Brandes inquired if the lease would be brought back to <br />Council for approval. <br /> <br /> Mr. Roush replied that the lease will be w~itten in such a <br />way that appropriate notice can be given and the lease terminated <br />with or without cause. He stated that the structures Strizzi's <br />will put up would not be a significant capital improvement since <br />they will take it down every night. The details would be worked <br />out with the Design Review Board and the City Council. Strizzi's <br />now has a public liability insurance policy which will cover <br />anyone who might get hurt. <br /> <br /> Mr. Brandes indicated that it was inappropriate to lease <br />public property to a private business and that he would like the <br />final lease to come to Council. <br /> <br /> Mr. Roush stated that that could be done. <br /> <br /> It was moved by Mr. Mohr, and seconded by Mr. Tarver, that <br />a lease with Strizzi's Restaurant for the adjacent City property <br />be approved, the final terms of which will be returned to City <br />Council for consideration. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Tarver and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />14. COMMUNICATIONS <br /> <br /> There were no communications presented at this meeting. <br /> <br />15. CITY COUNCIL CALENDAR <br /> <br /> Mr. Bocian presented the City Council Calendar for the <br />information of the Councilmembers. <br /> <br />16.
