63 <br /> <br /> It was moved by Mr. Tarver, and seconded by Mr. Mercer, to <br />select Option 2: Have a joint City Council and Planning <br />Commission Work Session, focusing the City Council's discussion on <br />annexation issues at the work session and the Planning <br />Commission's discussion on the EIR at a separate public hearing. <br />This would clarify the distinction between environmental and <br />annexation issues, both of which will be made part of the record <br />and subject to public testimony. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />Item 12c <br />Proposed Livermore Airport Protection Area <br /> <br /> Mr. Bocian presented his report (SR 90:47) regarding the <br />matter. <br /> <br /> Ms. Mohr inquired if the revised map would allow the buffer <br />strip of housing that was proposed behind the existing Pleasanton <br />Meadows Homes. <br /> <br /> Mr. Mercer asked if the staff has changed its recommendations <br />based on this revised map. <br /> <br /> Mr. Chandler Lee, Principal Planner for the City of <br />Pleasanton, indicated that the revised map would allow the housing <br />mentioned by Ms. Mohr and that staff still maintains that the <br />Stoneridge Drive Specific Plan that Council adopted two months ago <br />had all these details worked out. It did not include an avigation <br />easement, either within the residential or industrial-commercial <br />areas. <br /> <br /> Mr. Brandes stated that this is a legitimate concern. He <br />added that he could not understand why avigation easements would <br />consider distinctions between residential and industrial- <br />commercial areas. <br /> <br /> Mr. Lee explained that the Stoneridge Drive Specific Plan <br />presented two different ways of dealing with the noise problem. <br />The first was the avigation easement, a legal document which <br />basically gives the airport the right to fly planes over <br />properties and make noise. The second, which was recommended by <br />the staff and endorsed by the Council, was the real estate <br />disclosure notice, which basically informs all residential and <br />commercial property owners that there is an airport in the area <br />and that there will be noise.
