451 <br /> <br /> MINUTES <br /> OF <br /> THE CONTINUED MEETING <br /> OF <br /> THE CITY COUNCIL <br /> <br /> AUGUST 22, 1990 <br /> <br />1. CALL TO ORDER <br /> <br /> Mayor Kenneth R. Mercer called the Continued Meeting of the <br />August 21, 1990 City Council Meeting to order at 5:00 p.m. <br /> <br /> 2. ROLL CALL <br /> <br /> City Clerk Peggy L. Ezidro called the roll which is recorded <br />as follows: Councilmembers Frank C. Brandes, Jr., Robert E. <br />Butler, Karin Mohr, Ben Tarver, and Mayor Mercer. Staff members <br />present were: Deborah Acosta, City Manager; Michael H. Roush, City <br />Attorney; and Brian W. Swift, Director of Planning and Community <br />Development. <br /> <br /> 3. MATTERS CONTINUED FOR DECISION <br /> Item 3a <br /> Reconsideration of Pleasant Village Center <br /> <br /> Mr. Mercer explained that this item was continued because at <br /> its August 21st meeting, Council voted to reconsider its earlier <br /> decision regarding Pleasant Village Center. <br /> <br /> Mr. James Miller, 3633 Camelot Court, indicated that he <br /> strongly objected to the City allowing a person to continue the <br /> construction of a building that has a cease order and a red tag on <br /> its permit. He stated that the developer should conform to the <br /> plans submitted under Measure X and that Council should direct him <br /> to reduce the height of his building, as required under Measure X. <br /> <br /> Mr. Henry Hatton, 3963 Fairlands Drive, pointed out that the <br /> first condition of Exhibit A was that the development substantially <br /> conformwith the plans on file at the Planning Department, and that <br /> the plans submitted by the developer, Mr. Steve Thomas, violated <br /> the plans on file. Mr. Hatton stated that Mr. Thomas had the same <br /> architect and architectural engineering firm as the developer that <br /> submitted the plans on file. He added that at a meeting of the <br /> Planning staff, Shell Oil Company, the architect and the neighbors <br /> held on February 16, 1989, he had requested the courtesy to review <br /> the plans when these were submitted but that he was not notified <br /> when the plans came in. He said that the City made an error by <br /> approving the plans, but that the developer and his architect <br /> committed a greater violation by submitting plans that did not <br /> <br /> 8-22-90 <br /> - 1 - <br /> <br /> <br />
