432 <br /> <br /> This condition would eliminate any uncertainty or confusion in the <br /> future. <br /> <br /> Mr. George Callahan, 813 Gray Fox Circle, inquired if this <br /> condition would be recorded against every lot in the subdivision of <br /> just against Lot 3. <br /> <br /> Mr. Roush replied that the more precise conditions would arise <br /> in the context of particular applications. <br /> <br /> Mr. Tarver stated that the condition would protect the <br /> concerns of the neighbors regarding privacy and the quality of life <br /> and would give everyone a chance to be protected by the process. <br /> <br /> Mr. Mercer commented that the original plan was for 13 lots <br /> but Council ultimately approved a 14-lot plan with tree locations <br /> set for the 13-lot plan. The planting of trees in existing back <br /> yards would provide the needed privacy in the neighborhood. He <br /> indicated that he would support the application because the two <br /> neighbors concerned are in agreement with respect to what should be <br /> done in the back yard. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Tarver, that <br /> Resolution No. 90-156 be adopted, approving Z-90-326, the <br /> application of Charles Suer to regrade a portion of the rear yard <br /> located at 949 Montevino Drive (Lot 3, Tract 5948, Vintage <br /> Heights II), as set forth in the Staff Report. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Tarver, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: Councilmembers Butler and Mohr <br /> <br /> Item 6b <br /> Z-90-469t Application of Don and Melissa Pederson to Regrade a <br /> Portion of the Rear Yard Located at 971 Montevino Drive (Lot 2, <br /> Tract 5948, Vintaqe Heights II) <br /> <br /> Mr. Swift presented his report (SR 90:337) regarding the <br /> matter. <br /> <br /> Mr. Butler and Ms. Mohr abstained from this discussion as <br /> well. <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> Mr. Don Pederson, 971 Montevino Drive, stated that he would <br /> not agree to any amendments or changes to the exisiting conditions <br /> of approval.
