PUBLIC HEARINGS
Item 6a
Z-90-326, Application of Charles Suet to Regrade a Portion of the
Rear Yard Located at 949 Montevino Drive (Lot 3, Tract 5948,
Vintaqe Heiqhts II)

Mr. Swift presented his report (SR 90:325) regarding the
matter.

Mr. Butler and Ms. Mohr abstained from the discussion because
they own stock in Amador Valley Savings and Loan, which developed
the project and which is the party responsible for the public
improvements on the project.

Mr. Mercer declared the public hearing open on the
application.

Mr. Charles Suer, 949 Montevino Drive, stated that he agreed
with the conditions requested by his neighbors, the Johnstons,
regarding the landscaping, the maintenance of the drainage ditch
and the addition of trees and sprinklers. However, he disagreed
with the condition that no above-ground structures be allowed on
the new grading plans.

Mr. Don Pederson, 971 Montevino Drive, stated that he
supported Mr. Suer's application and that it should be approved.

Ms. Lisa Johnston, 3110 Catawba Court, indicated that she
agreed with most of the proposed conditions of approval. She
clarified that she was not opposed to any above-ground structures
like sheds and that she had agreed to allow 19 inches of regrading,
along with a partial landscape plan for the lower portion of the
yard so long as no raised deck went on top of the 19 inches. She
added that if this were allowed, she would want her fence adjusted
to be a higher fence.

Ms. Acosta explained that staff had included all above-ground
structures to avoid interpretations of the conditions in question
in the future.

8-21-90
- 6 -
