REPORTS OF THE CITY ATTORNEY
Item 6a
Amendment to Foothill/SAB Amended Development Deferment Agreement
and to the Mozart Amended Development Deferment Agreement

Mr. Roush presented his report (SR 90:304) regarding the
matter.

It was moved by Mr. Brandes, and seconded by Mr. Butler, to
approveAmendment No. 1 to the Foothill/SAB Deferment Agreement and
Amendment No. 6 to the Mozart Deferment Agreement, as set forth in
the Staff Report.
The roll call vote was as follows:
AYES: Councilmember Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Item 6b
Reimbursement Agreement with Crocker Properties, Inc. (Wells Fargo
Bank) for Stoneridge Corporate Plaza II

Mr. Roush presented his report (SR 90:306) regarding the
matter.

Ms. Alice Waterman, Manager of Stoneridge Mall, 1 Stoneridge
Mall Road, representing the Taubman Company, indicated that she was
in favor of the Wells Fargo development but expressed concern about
the post assessments. She explained that when Stoneridge was
initially approved, the Taubman Company was granted full
entitlement to develop the regional shopping center in phases and
that it has always been envisioned that it would be anchored by
five major department stores. The infrastructure, water lines,
utilities and roadways necessary were installed then. She stated
that she felt the Taubman Company should not be subjected to the
Reimbursement Agreement.

Mr. Brandes commented that everyone in Stoneridge would like
everything in the area to function properly and that the last party
to come in should not be made to pay for what is necessary to make
it work. He added that the Reimbursement Agreement is in the best
interest of the City and Taubman Company.

7-23-90

- 13 -
