MEETING OPEN TO THE PUBLIC

Mr. Henry Hatton, 3963 Fairlands Drive, inquired why the
retail shops behind the Shell Oil Company Service Station on the
corner of Pimlico Drive and Santa Rita Road were approved to be
built within seven feet of residential properties and to be 29
feet high. He pointed out that one of the provisions of Measure
"X", which approved the development, was "to install a series of
tree species along the southern property line which would have
less impact on the adjacent residential yards."

Mr. Mercer indicated that this matter was raised at the last
Council meeting. He referred the question to Mr. Swift.

Mr. Swift stated that the project is currently before the
Planning Commission for a proposed modification to the PUD but
that this modification does not affect the height or setback of
the building. He explained that the approved plan required a
setback of 20 feet except where it runs along the property lines
perpendicular to Santa Rita Road as opposed to along Fairlands
Drive, where a minimum setback of 10 feet was required. He added
that the height at the front of the building would be 29 feet but
that the rear would be only 25 feet. He indicated that staff from
the Planning and Building Departments have gone out to the site to
check the actual height and the setbacks of the development.

Mr. Mercer requested Mr. Hatton to contact Mr. Swift if he
wished to review the documents on the development.

- 3 -

6-19-90
