49 <br /> <br /> Ms. Mohr inquired if the electrical bills for the pumping and <br />distribution system would be the responsibility of the homeowners <br />association. <br /> <br /> Mr. Cooper said yes. <br /> <br /> Mr. Bob Graham, 2503 Vineyard Avenue, resident-owner of the <br />property, stated that he was in favor of the project because it is <br />done in fine taste, has open spaces and preserved the vineyard as <br />a setting for the houses to be developed. <br /> <br /> Ms. Kelly Tovey, EBRPD, stated that she had not had the chance <br />to review the updated Conditions of Approval, the proposed <br />alternative floor plan or the lowering of the trail along the <br />Arroyo. She indicated that after several meetings with Mr. <br />McDowell, the District had agreed to a ten-foot easement in those <br />areas that could not accommodate a 20-foot trail, as expressed in <br />Ms. Maxine Terner's July 5th letter to the City. She mentioned <br />that the trail is shown in the Shadow Cliffs Regional Recreation <br />Area Land Use Development Plan as well as in the District's Master <br />Plan; however, the District's Trails Coordinator or Environmental <br />Specialist would have to comment on the proposal to lower the <br />trail. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Resolution No. 90-186 be adopted, based on a review of an initial <br />environmental impact study done for this project and on a finding <br />that no significant environmental impact would occur as outlined in <br />the City's guidelines and on further finding that a negative <br />declaration is appropriate in connection with AP-90-13 (PUD-90-3), <br />McDowell, the appeal of the Planning Commission's denial for <br />development plan approval for a nine-lot, single-family detached <br />residential project on a 3.75 acre site located at 2503 Vineyard <br />Avenue. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br /> Mr. Brandes indicated that he would support the project <br />because it is one of the finest project in the City and because Mr. <br />McDowell has been sensitive to the concerns expressed by Council. <br /> <br /> 10-2-90 <br /> - 21 - <br /> <br /> <br />
