30 <br /> <br /> Ms. Acosta stated that the Homeowners Association and the <br /> attorney representing Manoj Dave have requested that Item 6a - <br /> AP-90-8, City Council Appeal of Case Z-89-557, Manoj Dave be <br /> continued. <br /> <br /> Mr. Brandes stated that at the last Council Meeting that this <br /> item was scheduled, Council had clearly specified that the matter <br /> would be considered at this meeting and that there would be no <br /> further continuance. He added that if Council opted to continue <br /> the appeal once again, a specific date should be set for final <br /> hearing. <br /> <br /> Mr. Mercer pointed out that this is the first time that the <br /> surrounding Homeowners Association has requested a continuance, <br /> since its members would like to meet further with the <br /> representatives of Mr. Dave. He indicated that he had no objection <br /> to considering the matter at the next Council meeting, if Council <br /> chooses to do so. <br /> <br /> Ms. Mohr commented that she wanted to deal with the matter at <br /> this meeting; however, because she did not want the parties <br /> involved to feel that they were not given the opportunity to <br /> resolve the issues, she was willing to continue it to the next <br /> Council meeting. <br /> <br /> Mr. Tarver concurred. <br /> <br /> Mr. Brandes suggested that if the neighbors who requested the <br /> continuation were present and are ready to testify, the matter <br /> could be considered at this time. <br /> <br /> Mr. Mercer inquired if the neighbors and representatives of <br /> Mr. Dave were present and ready to testify, which they were. Mr. <br /> Mercer then stated that the public hearing would be held, as <br /> scheduled. <br /> <br /> 4. CONSENT CALENDAR <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Tarver, that the <br /> following items listed on the Consent Calendar, as amended, be <br /> approved: <br /> <br /> a. Approval of the City Council Minutes for 9/18/90. <br /> <br /> b. Proclamation of October 21-28, 1990 as "Red Ribbon Week." <br /> <br /> c. Proclamation of October 7-13, 1990 as "Fire Prevention <br /> Week." <br /> <br /> 10-2-90 <br /> - 2 - <br /> <br /> <br />
