And if'the Council opts not to approve the project, the <br /> project would become null and void and would not need to go through <br /> Growth Management approval. <br /> <br /> Ms. Acosta asked the Council if, with the additional <br /> condition, the project would be subject to all the other conceptual <br /> housing provisions previously adopted by the Council. <br /> <br /> Mr. Tarvet replied that he would like to see the provisions <br /> apply to the affordable units of the project. <br /> <br /> Mr. Alborzi commented that he would like the option of paying <br /> the affordable housing fee and keeping the project as it is to <br /> remain open in the event that Sunwest is unable to include <br /> affordable units in the project. <br /> <br /> It was moved by Mr. Tarver, and seconded by Ms. Mohr, that <br /> Ordinance No. 1502 be introduced, to be read by title only and <br /> waiving further reading thereof, approving PUD-90-17, the <br /> application of Sunwest Horizon to rezone approximately 2.3 acres of <br /> land from the Agricultural Zoning District to the PUD - High <br /> Density Residential District and to approve a PUD development plan <br /> for the construction of 27 two-story townhomes, located generally <br /> east of the Old Santa Rita Road/Santa Rita Road street <br /> intersection, subject to the Conditions of Approval set forth in <br /> the Staff Report and to the addition of Condition No. 38 to read as <br /> follows: "The project shall provide four unit for sale to <br /> moderate-income households in accordance with the City's adopted <br /> moderate-income housing program. The units shall sell at the upper <br /> end of the moderate-income price range, and the developer may <br /> modify the unit size in order to achieve maximum affordability. In <br /> the event the developer and staff are unable to achieve four units <br /> meeting the moderate-income affordability level, the project shall <br /> be referred back to the City Council for its review of this <br /> requirement. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 6b <br /> PUD-90-19, Moller Properties, Application for Development Plan <br /> Approval to Construct a Total of 99 Residential Units on a 198 Acre <br /> Site, Generallv Located to the West/Northwest of the Foothill Road/ <br /> Muirwood Drive Street Intersection (SR 91:107) <br /> <br /> Mr. Mercer declared the public hearing open on the <br /> application. <br /> <br /> - 8 - <br /> 3-19-91 <br /> <br /> <br />
